    On October 25, 2023, we signed an agreement in which you agreed to demolish the current concrete pad and install a new 28x15 foot concrete pad with haunch. The price you quoted me for this work was $11,000, and I paid by check in three installments of $3666 on or around the time the work was completed. I noted on November 10, 2023 that the concrete pad was only 20x12. You agreed to provide a refund at that time, and refunded $1,000 on approximately November 15, 2023. A copy of our agreement is enclosed.

    Shortly after you completed your work, the Buffalo building inspector noted that the pad was improperly done. He told me at that time that he would not allow the garage to be built on the pad since it was off-level and off-center, and stated that a new pad would need to be poured. He also noted that you were not licensed in the City of Buffalo and did not obtain the appropriate permit. You incorrectly informed me that you did not need a permit because I had already obtained one. By the time we discovered the pad was done incorrectly, it was too cold to pour a new pad, which delayed the garage I planned to build until this spring.

    I am hiring a contractor to demolish the pad you poured as well as pour a new pad. This contractor, as well as the City of Buffalo building inspector, have outlined the following issues with the pad you poured:
    3 inches out of square
    1 inch short of the 12' agreed upon on the driveway side
    1 1/2 inches low in one corner
    not square on the property
    not as flat as it should be

    I am demanding a full refund of the money I paid for the pad you demolished as well as the pad you built, $10,000. I am also demanding damages of $3000 for the inconvenience of the delay in my garage project, many conversations I've needed to have with the City of Buffalo, and the time I have spent looking for a new contractor. Both the contractor and the City of Buffalo building inspector have advised that the work is so improperly done that a refund or lawsuit is warranted.

    Called business and spoke with owner and this was relayed:

    Last year, I did a pad for her and the measurements were off and I told her I would come back to repair, she requested $1k to settle the issue. I refunded her a thousand dollars and she accepted it and I feel that I have no liability.

    You can't take a refund regarding an issue and think your going to come back later for something else.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  Randy provided a $1,000 refund last year because he admitted that even though the pad was supposed to be 28x15, it was only 12x20. The $1,000 covers the shortage of concrete. It does not cover the fact that the pad is completely off level therefore I cannot build a garage on it. It is crumbling and poorly done. The following issues were brought to my attention by the Buffalo building inspector:

    -3 inches out of square
    -1 inch short of the 12' agreed upon on the driveway side
    -1 1/2 inches low in one corner
    -not square on the property
    -not as flat as it should be

    Furthermore Randy stated he was licensed in the city and he is not licensed.

    I will subpoena witnesses including the City of Buffalo building inspector in court to document these issues. The pad is currently being demoed and replaced tomorrow through Saturday. I have absolutely no reason to make up that the pad is unable to be utilized. Therefore, I am requesting a refund of the $10,000 (plus $3000 in damages as outlined in my letter). I paid to be applied to demo of the pad Randy put in as well as a new pad. I have already discussed the $1,000 refund with my attorney I retained for this matter, who stated it is not an acceptable resolution. We are prepared to serve a lawsuit over this matter if I am not provided with $13,000 for the unusable pad by May 22, 2023, as stipulated in our letter. If we have to go to court over this, not only will Randy need to provide the $13,000 refund plus damages but he will also need to pay my attorney fees which could easily amount to another $10,000. Randy, please resolve this matter promptly or we will be serving a lawsuit.
