On 8/15/2022 we hired Raymond Baker Jr home Improvement to install a deck and mud room. at the time we signed the contract on 8/15/2022 and we give Raymond a check that was cashed by him for 10,000.
Raymond told My Husband (**** ) and I that the job would be completed by Oct 31,2022.
However Raymond did not even start working on the job until 11/10/2022. As of this date 1/19/2023 the job is not completed. the work had to stop a month ago because we applied for a permit and we are waiting for him to show codes department his insurance paperwork. He has not done so as of 1/19/2023. we have given him plenty of time to go to codes to provide the nescessary paper work. All the paperwork on our end was completed and the permit we paid for we are just waitng on him to do his part. we have been very patient with him.we tried to call him to see why is isn't finishing the job. My husband email him to tell him to go to codes so that he could finish working, But he is not answering our calls or emails and he did not go to codes. At this point we told him that we want some of the down payment that we gave him and to end the contract, We had enough of him stalling us and not showing up for work and when he did show up it was for only two hours a couple days a week. It has been 6 months of trying to get him to complete our job.
.the only work he did was to built the mud room frame and the wall are not complted or has any or the mud room enclosed. All the framing is getting runied by the weather. He has not even started building the deck frame.
our contract was to remove siding from front of home
    remove exisiting deck
set sono tube's to accept new deck.
install a 26ft+8feet -18ft =8feet to wrap around the side of house
install trex decking with white vinyl railing and post
    construct 8ft=8ft enclosed room
install roof joist's along front of home attacking into the wall just below the soffit. install new entry door and window.
uploaded the rest of the contract.
    Thanks

Yes I was working the job. And they left out quite a bit. For starters I had two employees working everyday weather permitting. I was tending to other business in which they were unable to understand..Mr.**** was changing the design telling my guys to do it differently from the contract. I received numerous threats from the both of them. The hostile environment was created. I have not heard of any settlement offer. They wanted everything returned and I have done about 6800 work and materials. At least. They wanted worker's comp and I am owner operator and I have 1099 worker's. I have general liability. I have never had to present worker's comp to anyone. Another thing is it was the homeowner request that we try to do the job without a permit! Not mine

    Customer Answer

Mr. Baker of Raymond A. Baker Jr. Home
Improvement was hired on 8/24/2022 to build a deck and mud room and
complete it by Oct 31, 2022. Which never was completed, due to
failure to perform work by the agreement day . Mr. Baker on either 5
or 6 occasions gave us days that he would begin work on our project
between 08/24/22 and 10/31/22, the completion date. He never showed
up on any of them. That led us to believe he may not show up at all.
We gave him 10,000 In August and he cashed it on 8/25/22, but didn't
even start working until mid November. Yes we were very disappointed
with him but we never threaten him, I can't believe he could even say
that about us. We treated them good, we made coffee and gave them
snacks when they did show up for work. You said it was a hostile work
environment which it wasn't for you and your workers you were hardly
ever working , but for us it was very stressful wondering if you were
going to show up for work every day that went by. There were some
nice days that they could of worked, but never did. They finally
started to work In the middle of November but ended work on 12/9/22 ,
that was the last day they showed up to work.. The work that was
completed was of poor workmanship and has to all be redone. We as
consumers can not schedule his work. He should not be promising
completion dates to sell jobs if he is not capable of keeping them.
We did request a full refund prior to him beginning work, if he was
not willing to sign a statement with a new completion date of
12/07/22, which he agreed to and did. With the other requests for
refunds both on the phone and by email we asked him to let us know
how much of our down payment he was willing to return. He never
contacted us, because of that we did send a letter of demand for a
full refund, but just below the request in the demand letter is a
statement that we are willing to meet with a mediator to try to come
to an agreement for a refund. Mr. Baker did say he did not think we
needed a permit and if it turned out we did, we could easily obtain
one. The only reason we got to this point is because he never showed
the building inspector the requested form. The building inspector was
even nice enough to give me the information of where Mr. Baker could
get the waiver form required, if he is working on his own and
hiring sub-contractors. I passed the information on to Mr. Baker. He
never contacted the building inspector. I gave him almost a month to
do his small part so the building permit could be issued. The permit
was already payed for and all other requirements completed. The
inspector was just waiting on Mr. Baker and Mr. Baker knew all of
this. This has been a very frustrating experience for us.
