Signed a contract with Brock’s Contracting for 2022/2023 snow removal. Paid $400 and have receipt of payment. Brock’s contracting has defaulted on the contract as he has not plowed my driveway once. Have reached out multiple times through phone call with voicemail and multiple text messages. Requesting for a full refund. First and last page of contract attached.Business Response

My truck broke down at the end of February. The customers got plowed all winter long. At this time there's nothing I can do because my truck is broke down. I talked to law enforcement and was told to contact the customers via letter offering a resolution, which I did.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. Chad Brockman plowed the driveway a total of ZERO times. He also never staked the driveway even after my multiple text messages with response from him that he “was at a doctors appt and will be by to stake after” this never happened. I also sent him pictures of the snow being over 3 “ which he never replied to. I have a text string saved that requests both staking as well as plowing and he said he “will be there “ and to “not lose faith” in him. I have a contract. Documentation and text messages where he never said anything about his truck. I also sent him multiple text messages asking him to contact me so we can resolve this and to return my ***** funds ($400) as well as giving him another opportunity to contact me otherwise I will have no choice other than to seek a legal remedy. All of which were ignored even though there was a read receipt on the text message, so there is proof that he read it. Regards, ****** ****Initial Complaint

On Dec 10th 2022 I entered into a snow plow contract with Chad Brockman of Brock's contracting. We paid $400 for snow plowing service through April 1st. We ad a significant snow fall on 3/3/23-3/4/23. I've tried contacting him, very nicely several different ways including his ******** that has since been taken down, phone calls, which were no answer, but left messages asking for an estimated time and text messages. I have adequate time in between and have not heard anything. And our driveway has not been plowed as of today 3/5/23. I also see his web page is no longer in service. I was made aware of him being a possible scammer on 3/4/23 and reached out to another homeowner whom this also is happening to and she stated there are approximately 7-8 other people in Wayne county, NY that is having the same problems with no show and no answer when contacted. I do know the one did take him to small claims, he was a no show there. I have all recorded documentation of myself trying to contact them, as well as their business card and my contract that was signed.Business Response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.I don't accept this response. If his truck broke down, why was no one notified. And if hat is the case, it's his responsibility to find alternatives to finish his plowing contracts at his expense according to his contract. Also according to his contract if he defaults in his obligations, then a full refund is expected. I had heard absolutely nothing in my attempts to contact him. Only when I contacted the sheriff's department did he respond offering 50% back to me. He stated he would send a resolution letter on March 8th. It is now March 21st and I have not received any letter or any response regarding my refund. I had previously attached that conversation and sent it to BBB last week. Regards, ******* *******
