I went to Market in the square on 10/10/24 on division street in north tonwanda NY while I was shopping i noticed a shopping cart full of items reduced for quick sale and noticed there were products past their expiration date. I never shop here but my mom does. In the cart there was stuff as old as 6 month past the the expiration date. I let the manager know and she said that they sell stuff past the date all the time, she said this twice. They said they had no number for corporate and the manager won't be in till Sunday. When I went to leave the manager shook her head at me. When I got out to the car my mom had a small ice cream she was trying to open. I noticed that it expired 2 MONTHS AGO. I went back in and the service desk was closed so I asked for the manager. When I told her she clearly doesn't care since she shook her head she said "so what do you want? A refund" . She had an attitude the whole time, she had to have another employee use a binder and show her how to do a refund. When the guy gave me my money back the manager (Lori) said "I'm so sorry" in such a sarcastic way. This is NOT ok, you can't sell expired items, and you can't sell them for a discount. I will be filing complaints with the appropriate parties because people don't need to be getting sick over expired food.

      Business Response

      Date: 11/01/2024

We reviewed the details of this complaint. The items in question (after discussion with night manager) were those in a reduced shopping cart of items for quick sale. These are items that are near their "Best By" dates. These are not "Use by" or Expiration dates. In regards to the ice cream that was outdated, after investigation, it appears that that was a mistake on our end of a brand that was discontinued. It was a miss on our part and the customer was given a refund. After discussion with night management, they did not indicate that they presented to the customer with any attitude or sarcasm, but handled the queries and refund to the best of their ability. We strive to serve every customer to the best of our ability and rectify any issues in the best possible way. It appears that this customer was provided a refund for the outdated product. For the products that are in the quick sale cart, they are indicated that they are reduced for quick sale and any dates would be visible on products for customers to inspect. Like it was stated, these are generally "best by" dates which are not expiration dates. Thank you
