    We are no longer wanting to use their digital document storage or physical record storage. We need our digital data on a disk and we were made to pay in $2500 in advance, on March 20, 2024. To this date, we have not been able to obtain the disk, all the while they re continuing to charge us every month for digital data storage.

    In addition, we have requested numerous times for the physical location of our records, and a time and date we would be able to pick them up. This has been going on for months, all the while they are charging us monthly for storage.

    I believe these delays and non-responsiveness are intentional. Our property is being held hostage in order for this company to keep collecting monthly fees from us..

    We have made repeated requested on behalf of several clients to VRC Companies. d.b.a. VitalChart for production of medical records. Despite their knowledge of the Kentucky Revised Statutes, and our citation of the relevant KRS which states that they shall produce free copies of records, they refuse to do same. When I called the Lexington, KY representative identified at *************, she could not find the file and transferred me to a nasty national representative, who again refused to produce the records, despite acknowledging the applicable statute. This is a FOR-PROFIT business that the University of Kentucky Medical Center and Lexington Clinic has hired as a third-party to address their medical records requests. UK and Lexington Clinic and VRC are refusing to acknowledge the applicable law and are attempting to illegally charge for copies of medical records.

    rejected requests.

    $30 certification fee added (Note:  The
    certification fee is not included in the Kentucky law.  Only the records are free.)

    the free copy is not referenced in the request.

    Above information is submitted to
    demonstrate there is no pattern of VRC not applying applicable Kentucky
    law.  We have processed requests for both
    facilities for more than five years each.

    The complaint is about one request received on
    06/25/2024.  That request does not reference the Kentucky one-free-copy law. 
    We processed the request and charged per the usual Kentucky state
    law.  

    **. ******** was advised she could withdraw the
    request and resubmit the request with the free copy
    referenced. Lexington Clinic policy requires the
    free copy to be referenced on either the authorization or the Right of Access
    request written and signed by the patient. 
    This prevents free copies being produced when the patient did not intend
    that to happen.
