I signed a contract on 6/23/2023 for roofing and siding and downspouts. Two pieces of the siding are loose and it needs another downspout. I have talked to **** the salesman and he has tried to get the work done for me. The company has not sent anyone out to get this resolved and **** no longer works for the company any longer. I signed a contract for $53000 and the company has been paid in full. I need to get this resolved. I can be reached at ************ and would appreciate your assistance. I have talked with **** the salesman several times and was assured it would be taken care of. Since **** is no longer with the company I need your involvement to get this done.

I do not show any record of this customer calling in to discuss an issue with their siding anytime in 2024.  With that being said the labor warranty, as stated on their contract, for their siding has expired.

I went through every work order we have from March 2021 to November 2022 and I don't show any calls about repairs being needed for siding.  I also went back through the notes from your account and the only issue I see is one from 8/24/2021 that was repaired.  That issue had nothing to do with siding.  As a company we strive to make our customer's happy and we have no problem with coming out and doing repairs as long as the issue is reported before the warranty expires.

On 11-11-23 I signed a contract with ****** to replace my roof. I also decided on gutter gaurds. **** came to my home and did the estimate. **** told me the estimate was for the entire house and he accounted for 39 squares. This estimate was going through my home insurance under hail damage. ***** estimate was hand written and on a generic check list type of estimate. The estimate was not detailed and did not specify what materials other than the shingle they were using. The estimate did not state what the roofing cover material brand would be or what the water barrier material brand will be. **** never even showed me any pictures of what the gutter guards I was paying for. In was late in the season and so I had to wait until spring to get the work done. To make matters worse i realized that **** wrote on my estimate that the back addition was not included in his estimate. He never metioned that to me as he told me his estimate was for the entire home. In February, i decided to get a second estimate when i realized that lindsey contract had subtracted the addition to my home. I asked **** why he did that and he replied it was for insurance purposes only, that did not sit well with me as they were not legally obligated to do the addition since I signed the contract by mistake. Long story short this company calls me 3-8-24 to say they can put me on next week. I call the guy back stating to him that I do not want to do business with his company and to not order anything. On 3-9-24 the owner of the company calls me and threatens to *** me if I do not do business with him. I told him he did not lose anything from be cancelling with him. Now over three months later with no contact or no heads up he's acting like he already order the material an took a lose. Luckily i save the voicemail from **** which he admits to calling me to set something up next week but nothing is definite yet he replied. Now all of a sudden when I cancel, low and behold they ordered the material!

As you know per our contract our work begins wants we start to negotiate a settlement with your insurance company. You would not have been paid if it wasnt for the work we performed on your behalf.

[[BBB transcription via Attorney General Complaint No. 1051229, received 3/20/2024, see attachment for complete details]]

    Description:
On 11-11-23 I signed a contract with the company to replace my entire roof. The agreement was for my
entire roof to be replaced as this was going through an insurance claim. Due to being late in the season,
my roof could not be replaced until spring of the following year. In February I discovered that **** put on
my contract that the addition on my home was not included to the insurance even though he verbally told
me that my estimate was for the entire roof. When I confronted **** about this when he called me in the
spring to see when I wanted to to put me on the schedule i confronted him about this is***. He replied to
me that it was for insurance purposes. That answer did not sit well with me as per the contract he was
not legally obligated to do the addition on my home. I do not know what his intentions were, but they did
not match our agreed upon terms. Once I said I did not feel comfortable with his company his boss
called me the next day and threatened to *** me. On his contract there was a back page on the one
sheet that was not disclosed to me. I had no idea there was even any writing on the back of this paper.
**** never went through any of the disclosures of his contract. The contract states that if you cancel the
owner can charge 25% of the agreed upon amount for cancelling. What kind of contract is this to allow
him to charge such a heavy penalty? When I went on ****** reviews I noticed that I am not the only
person this owner is threatening to *** for doing absolutely no work what so ever.

    Satisfactory Solution:
Leave me alone and do not put a frivolous lien on my home when you know you did nothing for me. My
cancelation was due to your under handed dealing.

Around 3/19/23 ****** from Lindsey construction, was going door to door checking roofs for hail damage. Upon inspection of my roof had hail damage and an insurance claim was filed. On 4/19, I decided to let Lindsey construction replace my roof. Per my contract the only out of pocket cost would be my deductible for the insurance. I signed my contract. Two days after the roof was complete, Lindsey and my insurance company were emailing back and forth about plywood that was replaced by the company stating they brought it up to code. My insurance company added me to the emails that were being sent. Prior to the emails, I had no knowledge of any plywood being replaced. Around 4/25, ****** came to my house to pick up the first check and I asked him what was going on. He explained to me that it was no big deal and they had replaced 20 sheets of plywood stating the wood was falling apart. He said he didn't know why the insurance company was giving them such a tough time. I was shocked, no one notified me of any extra work being done. About 3 days later ****** texted me asking if I had coding on my insurance. I spoke with my insurance company around 5/2, and they were not aware of any plywood being replaced until after the job was complete. My insurance company declined to cover the cost for the plywood. On 5/2, I received a call from a seemingly angry **** ******** Until that call, I only talked with ******. **** ******* said I owed $1,000 and when I was paying the money. I explained, no one informed me prior to the work being completed. I never received a modification to the signed agreement or an invoice. I told **** that I wasn’t paying anything until I could see receipts and get an understanding of what was done at my home. To this date my contract is paid. On 5/16 I received an invoice for an amount of $1,200 and a letter stating that I had until 5/25/23to pay off this $1,200 or they’re placing a lien on my property. This is poor business and poor customer service.

We had to replace the plywood on the house to bring the house up to **** Building Code.  His policy unfortunately did not have the building code coverage on it.  We made an offer to the customer to only pay for the labor and material of the plywood replacement.

    Customer Answer

    Date: 06/01/2023

I am rejecting this response because: My policy does have building code coverage. From my understanding Lindsey construction did not follow proper procedure When they did this supposed code upgrade.

This contractor did completely substandard work to the concrete in my driveway and around my swimming pool. The spouting is leaking onto a large settled crack, around the pool. It was mislaid once and had to be put in twice because allegedly, the mix was too dry to be laid originally! The spouting and leaf filters they put in, weren't installed properly, to the spouting, leaking and falling out, because it was just laid in the trough and wasn't anchored properly. If I hadn't checked, they tried to get away with not putting in the leaf filters, if I hadn't checked and caught it!The patio room addition was not done properly and needs torn up, so that utilities can be installed because it is to be used as an extra room. Again ******* clearly knew this but always tries to cut corners, if you don't constantly check their work and have the zoning inspectors check! The basketball pole and backboard are an example, of their unprofessional, substandard, sloppy work they do. It was put in sideways and could have simply been corrected but no one ever even stopped back, to correct it.The landscaping they did to the pool was non existent and to this date, is uneven and settled to the point that it looks worse than when it was put in.These people are totally incompetent thieves, that are out to scam the consumer. They never had a total, competent crew on a job, as they were quitting and replacing inexperienced people with EVEN LESS experienced people. An investigation should be turned over to the county prosecutor for consumer fraud / thief because these people are merely are not craftsmen, trained in the trades necessary to compete a job, professionally. They are merely general laborers, so the owner can maximize his profit, while scamming the consumer!

Customer ***** is from 2015.  I am sorry that his experience with our company was less than excellent.  We do have skilled roofers, ****** and general contractors that have many specialties that work for **.  We do not cut corners when it comes to taking care of our customers. We are not in business to scam our customers or deceive them in any way.  We absolutely value our customers and always want them to be satisfied.  There is no longer a labor warranty on this job.

I had a roof that needed to be completed.original contractor was not able to do the job, i already had the materials on my roof. my mother had her roof done by this company was happy.i gave her contractor a call (***). i sent him all my papers from my insurance and he came out and looked at it all and we talked about doing the gutters on my garage. Which we would pay out of pocket for it was not on a claim. We signed a contract with him for him to do the garage. We had already paid 5,000 for materials all we needed was the labor done. He wrote the contract for 10,527 which was the full amount from the insurance, we paid him 2,000 that day which was our deductible. On the contract he wrote has material labor only but then writes on the bottom that we needed more materials. He knew that the 10,727 was the total we were getting from insurance for material and labor. they came out a week later did the roof. the roof was bumpy looking at first and seemed to get better as the day got hot. the crew was friendly and cleaned everything up. insurance gave us our 2nd payment and i contacted *** and asked him what we owed and he said 8,527. I told him that was incorrect that was for labor and materials and materials was 5,000 which he had the receipt from where i bought them. he said he would take care of it and i wouldn't have to pay anything which is what he said from the beginning. i called main office and talked to ********* she had someone work on it from finance. they sent me another bill stating that i owed 7500 (gave me almost 3,000 credits for material). I called that day and said it was incorrect never heard from them for another week. On nov 23 i get a call from eric lindsey saying he was collecting balance owed. i told him the roof was not done right my insurance had inspected it and it needed fixed. said he would be out next week to look at it. Told him he would not get the 4500 from insurance till job was done. Got a letter 2 days later for a lien on my house.

    Business Response

    Date: 11/30/2022

The customer and Lindsey Construction came to an agreement over pricing and we will release the lien as soon as we collect final payment.

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.

Lindsey construction came and fixed the roof yesterday. Came to the agreement that they would accept what insurance was paying. Suppose to pick up the money tomorrow and said they would take lien off of house.

I have been asking for an itemized invoice/receipt of all work that was completed on my home by this company. They are refusing to provide this. I had asked the owner,****,about items that were not completed on my scope of loss, provided by ******,my homeowner's insurance. My adjuster is telling me,all items should have been completed. **** is telling me that is not the case. I intend on paying the bill. He had no contact with me for months,no follow through/up and has shown up at my house, more than once, insisting on being paid, just in the last few weeks and is insisting he is putting a lien on my home. I believe it is normal business practice to provide customers with a receipt from any service contractor, when work is completed. I have always received one, esp.for my records, also to confirm what was completed,in case I have any issues, with the materials in future,to go by.

    Business Response

    Date: 11/23/2022

We honor the contract that was signed, by the customer, as far as what work we are completing from the scope.  We did not send in an in full completion to Grange.  We took off the work that we didnt do that was on the scope of loss, before we sent it over to the insurance adjuster.  We honored our end of the contract and completed everything that was contracted for by the customer.  It was the customers choice to remove a door, add a window and upgrade to the commercial gutters.  ********************* did not pay for those items, so we traded off items.  As far as the invoice goes, we do not break our invoices down by line item.  They are broken down into what the contract was for, and then any supplements, like an additional fee or customer credit.  The work has been completed for months.  We just want paid.
