- Paid $4,424 on 29 Dec'23 to Sound Health Altern (740-6989119OH) for Professional Physician-level training -
I signed a contract (included terms -once I receive the materials for course, after 14 days, NO refunds are possible)-
Due to two unanticipated medical issues - a Torn Spinal Cord and a Right Shoulder A-C Separation (with MRI report &Xray submitted as proof to Sound Health) - my training was delayed -
Prior to begining training, I experienced numerous odering/shipping discrepancy problems;
poor directions on how to use equipment;
difficulties with prompt & effective communication -
When well enough to begin the training (scheduled for 5Aug'24), I was informed that I needed to complete prerequisite training as per PORTAL PARTICIPATION GUIDELINES I was provided. --> It's IMPOSSIBLE to complete the prerequisite steps to allow for the actual training with ****** ******!
A- website link to "Join the Community" does NOT work
B- numerous error messages when trying to "subscribe" &pay monthly fees as required.
C- the video training is SERIOUSLY Out-of-Date, offering training on required 'Audacity' software valid in 2015! As such, I could not adjust the 2024 version of softward to provide a prerequisite 'Voice Print' (#7).
D- ****** ******* claimed she didn't know the software updated andsuggested I hire one of her IT guys at an additional $50/hour to get the current version of required software to work to even do the training! IOW, the training provided (that I paid $4,424 for) does not allow for one to complete the prerequisite steps for the actual training!
E- Steps #8 & #9 are impossible to complete. The links are so old, they don't work.
F- They even refunded my $34.95/mo subscription on 9Aug'24, so I cannot even do the prereq. training!

*********** ********* called our office on 12/29/23. He requested immediate entry into our professional class.He stated that the invoice must be dated before the first of the year for tax purposes. He signed and returned our contractual agreement on the same day-12/29/23. Our contractual agreement has a Refund Policy. The policy states:
Refund Policy
Refund issued to original payee with written request only. If received more than 60 days prior to the start of class, we will issue a full refund. If between ***** days
prior a 50% refund. Within 14 days, NO refund. You may apply the entire amount paid to a future class if taken within one year of payment. If we cancel class, you
will be entitled to a full refund unless you have received your class materials, in which case you can reschedule for any future class. Deposits are subject to the same policy.
US FUNDS ONLY!
Refunds are NOT possible after you have received and registered your Software and when you have received your Digital Class Materials.

Mr. ********* has received his equipment and materials. Since those materials contain intellectual property, there can be no refund.
***** ********* declined to schedule classes for late February. Reason given, he had a major spinal injury. He vanished for five months. In August he scheduled his classes to start on the 5th at 5PM Eastern time, 3PM his time. The day he was to start class, August 5th, he canceled again. The reason this time was due to a shoulder injury.
We asked him if he would like to send us a vocal print so we may attempt to help with his injury. This is what we do here at Sound Health Options. We research the connections between sound and health. We had previously sent him all the equipment and software he needed to record his vocal print. If ***** had finished his prerequisites, he would have had the ability to send us a vocal print. He did not perform the prerequisite tasks at all. He insisted that the program Audacity, which isnt ours, its a free download from the internet, wasnt working properly and he was unable to record a vocal print. We had our IT person give him a call to see if he could help. It turned out that ***** didnt have the volume on his microphone turned up. He was having issues with our Workstation subscription.The Workstation saves all of his work for client referrals. He spoke with our workstation representative and his issues were taken care of. Later, He requested we cancel his subscription and give him a refund, which we did. He then began complaining that he no longer had the subscription.
Our Portal opened in 2015 and has been regularly updated. We have had zero disgruntled students until Mr. ********** We have found that he had trouble performing the simplest of tasks. We have had numerous people contact him regarding his issues. We will continue to help him as needed. We want to help him succeed. But he has refused that help. He is dead set on a FULL refund. That will not be possible. He needs to read the contractual agreement that he signed once more.We always honor our part of the agreement, and we genuinely want him to succeed. When he is ready, and his prerequisites are complete, we can resume.
We have 81 pages of correspondence with Mr. ********** If you would like to go over them let us know.

This is the *** Report demonstrating serious spinal injury, including a literal tear in the spinal cord that resulted in blood accumulation and 9/10 severe pain for months. ****** was sent a copy of this report. Injuries such as this take m a n y months to recover from, if at all. Yet in her BBB response to my complaint, ****** ******* states, "***** ********* declined to schedule classes for late February. Reason given, he had a major spinal injury. He vanished for five months." I did not vanish. I demonstrated valid medical proof of a severe spinal injury that grossly impaired my ability to function for about three months.Customer Answer

On the Sunday before my scheduled training to take place on 5Aug'24, I injured my right shoulder. I provided the attached valid medical proof of injury to ****** *******. Yet here is what she stated in her written response to my BBB complaint: "In August he scheduled his classes to start on the 5th at 5PM Eastern time, 3PM his time. I have repeatedly requested a full refund from Sound Health because of their unethical business practices.
Part of that refund I requested (other than the $4,424 I paid for professional instruction) includes a monthly portal subscription for the ability to access Sound Health's analysis of the "voice print" data submitted through the portal.
On 9Aug'24, I received an email from them refunding my initial payment for the monthly portal subscription, which I was glad to receive. It demonstrated that they acknowledged that I had, via email, requested a refund.
Despite this, they made continued attempts to bill my card ***** on file for the subscription I cancelled.
As this account was necessarily closed, on the counsel of my bank since there had been fraudulent charges placed on it out-of-state, I was initially not concerned since Sound Health could not continue to draw the funds from it.
However, I recieved via email an "Invoice for renewal order *****" from Sound Health ****************** Center<*********************************************************************> on Firday 9/13/24 at 5:52pm MDT for the $34.95/month portal subscription that I cancelled and that Sound Health refunded me on 9Aug'24.
In that invoice there is a section that says, "This subscription is set to renew automatically using your payment method on file. You can manage or cancel this subscription from your my account page."
I decided to click it to again officially cancel my monthly subscription.
When I did, a Warning Message popped up, informing me "Your Connection is Not Private" "Attackers might be trying to steal your information from **********************************************************".
VERY IMPORTANT --> Since through this link I am to process information related to my financial information, shouldn't the link provided by the Sound Health Portal Subscription Invoice for me to access "my account page" be a secure link!?
Note that in the address bar that the https is listed in 'red font with a line strking it out!'

Only AFTER hitting the 'Reload' button on the WARNING PAGE that popped up immediately upon hitting the 'my account page' link on the Sound Health Portal Invoice, was I directed to a secure login page. Mr.********* signed a contract with us on 12/29/23. He was sent A** materials needed to take the class. Materials that include my intellectual property Protected by 114th Congress S. 1890 Defend Trade Secrets Act of 2016. The digital material was emailed multiple times. Apparently,according to his own statement (via Email) he had two email programs conflicting with each other. He brought to our attention that he was suffering from a spinal injury in February, 2024. This was at the time we were going to start his class. This was fine, he has one year to complete the program. We were willing to train him when he recovered. Once he recovered, five months later, he scheduled a date to start his classes. This date was August 5th.On the day of, he stated that he now injured his shoulder and would not be able to take the class again. That was still okay with us, we can schedule a date again when he recoversagain. Shortly thereafter Mr. ********** with his bad shoulder, began a long email correspondence with us. He was stating that he could not follow the simple instructions in our Portal Participation Guidelines. Mr. ********* stated that they were impossible to follow due to one reason or another. I had a couple people look into this. They had ZERO issues following the instructions. The only issue found was related to a How to use Zoom video on *******. The video was no longer available. In this case,all he needed to do was use the search bar on ******* (HOW TO USE ZOOM/AUDACITY)
He had issues with both ******* and the Audacity app. Both issues could have been resolved by using the ******* search function. We have had HUNDREDS of students follow the instructions without issue.
We have tried to help him. Our lead instructor contacted him to see if she could help. He has refused that help while demanding a full refund. Personally, I feel that Mr. ********* may be attempting to cheat the **** He was in a hurry to rush his payment through before the new year. At the last minute, he backed out of taking a class TWICE. He claims that our prerequisites are impossible when we have had hundreds of students complete them. I even had a person in his fifties, and unfamiliar with any of this, follow through with them to see if he could replicate Fabriciuss issues. No issues were found other than the how to use Zoom video.
Our contract clearly has a refund policy.

He clearly signed the contract. There can be no refund. He has until 12/29/24 to take a future class.
Issues Mr. ********* was having, and explanation:

Poor directions on how to use equipment. His inability to use the search bar on ******* (how to use Zoom/Audacity), and poor reading and comprehension.
It's IMPOSSIB*E to complete the prerequisite training as per PORTA* PARTICIPATION GUIDE*INES I was provided. He said he could not complete #7. Send us at least one vocal recording following the instructions in the SEND US booklet. I had one of my employees look into this. My employee followed the directions with no issues. Again, Mr. ********* must lack reading and comprehension skills.
Steps #8 & #9 are impossible to complete. The links are so old, they dont work. Number 8 provides a link to ***************************************************************** try it for yourself. Just dont forget the * in solutions like Mr ********* did.
Number 9 was a link to a How to use Zoom ******* link. YES, it was outdated and the video was no longer available. The solution was to type how to use Zoomin the search engine of *******.
One more thing. The contract also states that part of receiving equipment,software, texts and intellectual property, he agrees to keep the materials confidential. By offering to send our confidential material. This would be a BREACH of contract.****** ******* MeD

Although ****** ******* is hiding behind her Refund Policy, since she has not fufilled her part to provide the professional level training I contracted for and paid $4,424 for, and that I no longer can ethically associate or affiliate with her or her organization, I ask that you reason with her to capitualate and grant me a refund. She can grant a refund while still having me bound to her non-disclosure agreement.
Please help me in securing a refund.

Sound Health has responded to Fabricius complaints for the third time now. We have given two detailed responses. We consider this matter closed. This will be the third and last.
********* decided to sign a contract with us to train him in Bio Acoustic Biology. We sent him everything he needed to begin his journey. He backed out of two classes at the last minute. He had numerous personal issues with computer basics, and reading & comprehension. He did not finish the prerequisite training due to his own inadequate PC skills. He was offered assistance but refused it. Nothing is standing in his way other than his bad attitude and ineptitude.Regardless of his slander and libelous statements, he still has until 12/29/24 to schedule another class.
We would appreciate it if you, the BBB, would put an end to this back-and-forth nonsense. He has exceeded the limits of slander with his libelous accusations. If he continues, he may find himself in litigation. We will not be intimidated by his harassment and demands that we capitulate to his demands or he will continue his barrage of complaints to anyone willing to listen. This is BLACKMAIL! This matter is closed. He signed a contract, scheduled class, and he backed out last minute twice. The contract doesnt allow a full refund after a student cancels class at the last minute (twice). The contract also states no refund after delivery of thousands of dollars of our intellectual property. Our contract states that we will reschedule classes up to a year after payment. I suggest he swallow his pride, figure out how to retrieve email attachments and how to perform the simplest of PC functions, complete his prerequisites,then schedule the class he purchased.

Pardon me for my tardy response to ****** ******** 3rd Response to my complaint #********. Here it is.
As previously documented, I did contract with ****** ******* for training in Bio Acoustic Bilogy in exchange for over four thousand dollars.
As previously documented, the so-called training offered was of such a poor quality (outdated by literally 10 years) as to literally make it impossible to complete.
One has only to read the email exchange I've submitted to see the mutiple lies and obfuscation I received while trying to comply with what was asked of me.
As a licensed primary care physician with 27 years of experience, I applied myself fully to what was asked of me.
Due to two valid and unexpected medical emergencies, I did need to reschedule the contact training. Documentation for such has been previously provided.
I stand by EVERYTHING I've submitted here to the BBB.
Its evident that ****** ******* refuses to honorably refund me the monies I've paid her and that my only other option is to pursue this in court.
Reviewing the evidence I've submitted, any reasonable person would recognize the unethical business practices of ****** *******.
Even should I never recover a cent of the monies I paid, I cannot ethically continue to affiliate with her and therefore wisely choose not to pursue it.
There is No Blackmail. The notion is ludicrous.
