    We contracted *** to lay cement in our newly built garage. He subcontracted out the prep work to install drains, level, and tamp down the gravel. We paid the sub contractor directly for this work ($5,000) and paid *** $6,000 as a down payment for the cement. After the work by the subcontractor was performed it was not up to the specifications agreed upon. The cement was going to be only 2-3 inches thick, which is far less than required. *** came out to try to fix the problem, but it was still not fixed.We decided to go with a different company since we were unhappy so far and requested our $6,000 deposit back. He is refusing to give us back our deposit. He is saying it was for his work to fix the subcontractors work, which is not the case. We are $11,000 into our project and have absolutely nothing to show for it. Buyer beware.

    The homeowner dealt with the excavator directly not part of my bid.

    The money I was paid was for my labor cost at the site.

    The money was not a down payment.

    My company was there for 4 days prepping and setting drains.

    If there is was a problem with the excavation they should go after the excavator.

    Attached are the text messages between the owner **** and myself showing the payment was for work performed.

    Dimusio came and contracted to remove the existing coating, re-stain the concrete and then reseal. Dimusio told me they did not remove the old sealant and the bubbles were caused because they applied their sealant directly over acrylic sealant and it was not a good result. The job cost $6,200 and my patio, porch and front entrance is now a mass of bubbles.Dimusio came back with Xylene saying that would fix it. It did not. Finally he refused to fix the problem and now our concrete is a mess.

    I never said that the sealant was not compatible with the sealant that i applied.

    I told **** that i would be back to take care of the bubbles.

    I have had some health concerns in the last few weeks and haven't been able to do much

    The problem will be resolved when my ***** is better.
