    In November 2019, we signed a contract with Outdoor Design Build to have a patio and outdoor kitchen installed according to an architect drawing. We had an itemized, signed contract for work to begin ASAP and be completed February 2020. About ? of the way through the project, we had major concerns about the work being done and we expressed our thoughts. We were reassured that the issues would be addressed and the work would be perfect upon completion. Shortly after that began bills for items that were included in the original quote, but under good faith of getting the project complete we paid them (for example, stone pathway that was in the plans for the contract but they insisted the cost was not). We were also told several times that work permits were not required. We were notified of a final bill for a completed project, but there were several issues. We even made a 32 page word document outlining all of the problems and what we expected to be fixed in order to be considered complete. At this point the construction crew became very belligerent, trespassing after hours, throwing tools, cursing and name calling. We kept our resolve and insisted the items be corrected. By now we were going into June without fixes made, when the owner called my husband to say that his entire crew had quit, he had no way to fix our issues, and if we wanted the contract to be honored and warranty honored, then to sue him.
    We had a contractor inspect the electric, which after getting shocked by the non-buried landscape lighting wires, we were greatly suspicious of. We had also contacted our lawyer about the issues. We found out almost all of the electric was installed not to code and all required permitting. We paid to have this fixed, and contacted Outdoor Design Build to be compensated since this was still under warranty but had been refused to be fixed. They not only refused to compensate for fixing their issue, but called and harassed our contractor that we hired to

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  ODB offered no resolution and is making false claims.  I'm not sure what is the best next step for the BBB.  I can attach proof of many statements through emails I have saved, but several instances is now a he-said-she-said situation.  We have picture evidence to support our claims, except for the employees quitting which was verbally relayed.  Hopefully you've seen in the correspondence where the Mr. U******** himself stated that staff quit and now states that they did not.  We had several conversations with the staff about Mr. U********, but we did not record them.  We spoke openly and so did they about their frustrations with Mr. U********.  No defamatory social media posts have been made, and everything in print is factual and can be proven via phone records.

    Please advise what the best next step would be.  We understand that ODB does not stand by their work and refuses to compensate for poor workmanship that is not up to code and building standards according to NEC and ******** County.  But we at least made an agency aware of their dangerous business practices that could kill someone one day.     I've attached the contract, which contains the warranty.  Though we do argue that since work was never completed the warranty should not have started as the original project was never finished and what we're asking for is that the original work gets completed correctly.  Thank you.

    I've attached the punch list that we last sent the company.  Please note that some of the items on the list have been completed and are marked as such in the document.  The electrical items still marked as needing attention in the document we have fixed on our own and requested that the company compensate us for having to correct their errors and permit the work (which you will note in the contract is the responsibility of ODB).

    To summarize the attached document, our outstanding work complaints are:

    Uneven pavers that vary greater than 1/16th of an inch according the ADA

    Lack of proper installation of polymeric sand resulting in the majority of the pavers not having polymeric sand

    improper installation of drainage around pavilion

    improper base for pavilion

    improper installation of landscape barrier

    cracked tiles/pavers

    Using paver base instead of topsoil to replace garden soil removed during demolition

    seat wall falling apart (cracked tiles, concrete separation, lose tiles not properly installed)

     

    After working for two years trying to get it fixed, based on the belligerent nature of ODB, altercations with their employees in the past, and issues with trespassing, we are asking that a third party do the repairs as we  no longer trust or allow employees of ODB on our property.
