    Support Management Solutions assisted father, ******* ***** **** with his VA disability payments. My father passed away on 10-30-24 with a positive balance remaining in his account. I received one payment of $123.12 on 11-4-24 via Sharon, an employee with the company. She agreed to send the remaining balance of $362.54, which was stolen from my father and reimbursed by ***** **** in early December. After contacting Sharon on numerous occasions regarding the payment, her response was we haven't sent it out yet just in case there are pending payments due from his account. Please keep in mind my father passed in October and it's now February. I don't believe there would be anymore payments due but I expect the money is in the companies account for interest collection purposes. Now Sharon is asking if I established probate for my deceased father when that wasn't asked before. I already received a check from her in the past. Can you please take a look at the company to see if there is fraudulent activity happening with other deceased veterans or any veteran for that matter and ensure they send my father's remaining balance from his account? I should not have to establish probate for my father when Sharon already sent a payment and agreed to send a final payment without probate. Your help is greatly appreciated...

    Without probate there is no obligation to send any funds to *** ****, however we had chosen to honor his right as only heir to any remaining funds in the account to pay for funeral expenses. At the current time there are no funds available to give to *** ****.  Our auditor had to wait until the death certificate was on file to distribute any remaining funds.  When she saw the certificate date of death was more than two weeks prior to the date in which the death was reported she was aware that the VA could claw back the funds that were paid out. The VA did in fact choose to go that route and clawed back the entire November paycheck.  Funds had already been distributed to the landlord, electric company and the pharmacy from the account so that leaves the account in the negative over one thousand dollars.  At this time the organization will have to make that a claim against the estate to recover or right off the negative balance.
