Mortgage lists Mortgagors as **** ******* and **** *******, husband and wife. The title to the real estate is in the name of **** ** ******* only. **** ******* should be on the mortgage to release his DOWER interest in the real estate, not listed as a Mortgagor. He signed the note to make himself personally liable for the repayment of the loan.Business Response

This lady called our office a few times, and talked to my son, who communicated with me, in between her calls. she was rude and antagonistic to him, and just unwilling to listen. After a few calls, she demanded to talk to the att***ey in the office. When I called her back, I was very cold with her. I told her that her question had been asked answered several times, and that I did not appreciate her tone, aggresiveness and angriness with my son. He was exasperated from talking to her. I told her I would run through it one more time, and try to answer her questions. The call just devolved.
The crux of the matter is that both she and her husband executed the promissory note, thus becoming personally liable for the debt, which, when the loan goes unpaid, causes negative credit reporting.
While she was very smarmy in telling me that she couldn't be as smart as I am, because I'm an att***ey and she was only a paralegal, she then proceeded to tell me how we did her mortgage incorrectly. She ties the mortgage to the credit reporting, which rests instead with the executed note. I don't agree with her.

I was exasperated with the att***ey's son. The son closed the loan with me. I did not know the att***ey was his son. I tried to explain to the son that my husband was not a Mortgagor, but had to sign the mortgage releasing his dower interest only. I asked the son if the mortgage could be corrected to read **** *******, married to **** ******* who hereby releases his dower interest in the property. He insisted that **** ******* was a Mortgagor and kept talking over me as I was trying to tell him **** ******* made himself personally liable for the repayment of the loan, but he was not a Mortgagor. I told tell him the property was in my name **** *******, only and you cannot mortgage something you do not own. In his mind he was correct and would not listen to me. We were both talking at the same time. The first time I called I said the above to him and asked him to have the Company's att***ey call me and he said he would. No one called me back and after a few days I called him back again and again, he and I kept talking over each other He hung up on me and a few minutes later, the att***ey, his Dad, called me back and immediately started yelling at me, real professional, and accused me of calling his son a name which I did not. The att***ey did not want to listen to me either, he indicated he would hang up on me if I kept trying to explain. He told me the mortgage could be prepared with **** ******* listed as a Mortgagor or by releasing his dower. I said I guess I will have to get an att***ey to call you to get the mortgage corrected. He said YES HAVE AN ATT***EY CALL ME AND WE WILL HAVE AN IN INTELLIGENT CONVERSATION. That is when I told him I was a real estate paralegal for over 25 years and our law office represented a large building and loan I was far from smarmy. I've responded to the underlying question. I wrote that I was short with her. Now, she seems to be remembering, at least my conversation with her, things differently than I do.
I'm not going to devolve into a juvenile, he said, she said situation. I stand by my prior statement. At this point, I'm done with this question.

Mr. H*** has not addressed the issue of my complaint, nor has he come up with any solution.
I had requested Old Time Title to correct my present mortgage with ***** ******* **** to show **** ******* is the mortgagor and her husband, **** *******, is signing the mortgage to release his dower interest in the property. Property is in the name of **** ** *******.
My original mortgage to ***** ******* **** dated May 15, 1998, states "mortgagor is **** ** *******, married, whose husband's name is **** *******" and in the acknowledgment states "personally appeared **** ** *******, married whose husband is **** *******." This mortgage was prepared by ******** ***** ******* ***.
My home equity mortgage to ***** ******* Savings and Loan Association, prepared by ***** ****** of ***** ******* states "Borrower **** *******, Married," and ion the signature line states "**** ******* and **** ******* to Release Dower and in the acknowledgment states **** ******* and **** *******, To Release Dower."
The mortgage to ***** ******* **** dated March 29, 2017, prepared by David A. H***, that I am requesting to be corrected and rerecorded states "**** ******* and **** *******, as husband and wife, Borrower is the Mortgagor," the signature lines state "**** ******* **** ******* Borrower" and the acknowledgment states "**** ******* and **** *******, as husband and wife."

Business refused to provide details regarding obtainment of HOA letter. Rather they indicated that they must charge my credit care without awareness of cost. I was told only after the card is charged can they provide details about cost. They quoted 200-400. Upon doing own research, I was able to resolve the concern for 152$. It provided details about what amount would be charged before entering credit card information. Experimented with system and was able to know cost before charge under title company view. Due to them not providing these details and needing to complete my own obtainment of documents I was charged an additional rush fee (only ~100 without rush fee). This is vastly different than 400$. Upon speaking to agent they continued to refuse to provide cost details and indicated they would have had to charge with such a large cost.Business Response

Hoa dues / fees can be a big item, in any sale of a house. typically, its the sellers' responsibility to procur a status letter from their hoa, to show the amount and frequency of any fees /dues, and to show if those items are paid current. Most hoas in our area use third party vendors, to supply that information to parties, as required. These vendors, while in a range, can have varying fees. With that, we quote a range to customers, as, until we contact the hoa (to determine which vendor it uses), we can't be sure of the exact fees. While we usually request the status letters, we do tell people that, if they (the sellers and / or realtor agents) order it, its usually cheaper. By far, most people have us do it.
We do NOT mark these fees up. We usually get a credit card number from the seller / agent, and use that card to cover the applicable fees. We use their card, as, if the transaction doesn't close, our experience is that the sellers never reimburse us, for ordering the information for them.
As to rush fees, those are pretty common. Once a loan is approved, everyone involved wants to close asap. Most, if not all, of the hoa vendors know this, and charge accordingly. So, most, times, there is a rush fee incurred. But, again, that's something that would arise, once the status letter is ordered, with a closing date / required date listed.
I think that the complainant just really doesn't understand the issue, with why the information is necessary, and the process. When I received this email, I also knew exactly who you were referring too. To be nice, she stood out, from her phone conversations with our staff. Also, in our system, we have her last name as ********. I don't know if one name is a married name or not.

For your reference, reasons for rejection are included below.Basked on the service provided by your company, rush fees were required to be paid. This could have been avoided in several ways, including 1) employee contacting us sooner than less then 10 days to closing, 2) provided upfront information about how to obtain these documents (rather than reinforcing that my credit card number was required without payment amount), and/or 3) obtain ent of charge information prior to requesting credit card number. Due to any one of these factors an additional $100 was necessary to obtain the required documents. The professionalism and response at the time, as well as through prior responses here, also warrants attention, as I am disheartened to believe that others may receive the same treatment. At a minimum, I hope this can be a learning experience from all parties, including myself
