      In response to the complaint made by **** ***** ********.
      There are 2 contracts. (1= roof / 2 = Rear Entry Porch Enclosure)

      We have been in communication with the clients constantly
      and all items have been completed on both Contracts.

      Regarding the Roof Contract:

      **** ***** is stating written warranties were not offered. The roof has been completed since March 2022 and was paid in
      full. The warranty information is listed on the Contract and Exhibit that were
      approved and signed by the association. There is not an additional warranty to
      be given. We have stated multiple times that if the association would like the
      warranty specified in a different way, then please provide what you would like
      in writing, and we will submit that to our lawyer. We cannot just write out a
      warranty that is already specified in the contract. This should have been
      addressed during the contract signing. We are happy to have our lawyer review
      what you would like in writing regarding the warranty, but nothing has been
      provided and all terms are on the contract and exhibits.


      Regarding the Rear Porch Enclosure Contract:
      Security issue-If you wanted particular security items
      completed during the project, then that should have been broached before
      signing the contract.  Also, nothing regarding security was brought to our
      attention during the course of the project.  You stated there should have
      been night time security, night time lighting, chain link fence and a temp
      security door. I don’t understand why this is now being brought up.
      Again, this should have been brought up during the contract signing in
      order to have the additional security included.  The area had caution tape
      surrounding it and plywood was placed over the doorway opening. The area was
      secured and there was also no reports or incidents of trespassing, people
      entering the work site or anyone getting injured during the project.

      Written bill of materials: We do not provide a written bill
      of materials unless it is listed in the signed contract, or if we are working
      on a project that is billed for time and material, which would be stated on the
      contract. When PCI first provided an estimate on 05/05/21 there was an
      allowance for the lumber due to the spike in lumber costs at that time. The
      association did not want any open-end costs for lumber, so PCI provided an
      updated proposal on 06-23-21 with a total project cost. The association
      reviewed and approved this proposal. On 07/07/21 the contract and approved
      proposal was reviewed and signed by the association for the total project
      price.


      Regarding the outstanding Balance due by the Association:
      The balance for the rear porch enclosure contract which is
      due ($1500), will need to be sent to collections. Per the contract, this should
      have been received by the end of July 2022 and at this time is in default per
      the contract section VII Payment, IX Default and the pay schedule that
      were all approved by the association.
      There was an additional punch list the association requested
      in October 2022 to be completed after multiple attempts were made by PCI to
      collect the outstanding balance. PCI did not have an issue and did complete
      this additional punch list the following week.

      I am rejecting this response because: I have provided my responses to each of our concerns on the attached document,

      Why is it so hard to provide a written warranty beyond  10 year labor and 15 year materials

      There is not  a response to the $1500 charge for security.  

      There is still confusion over the final cost of lumber

      I am rejecting this response because: this issue is NOT complete. The association’s concerns have not been addressed (we would not have contacted the BBB if that were the case). Pomante’s responses regarding our concerns have been neither appropriate nor sufficient. Our payment was simply a sign of good faith.  It is the association’s wish that Pomante acknowledges the lack of security and refund that amount. Providing information regarding the cost of lumber was not addressed in the company’s message.   Contacting an attorney in regards to warranty appears to be a threat which is unnecessary at this time since we are attempting resolutions through BBB.
