      My mother owns a home in a retirement park this company owns. Due to health reasons she had to leave her home behind and move to ********* to be with family. We have a realtor who is with Greenlawn and they have not been doing their job and are not motivated to sell. We feel like something is not right and that it may be a conflict of interests with the realtor being part of the company that owns the community that she was living in. It is extremely important that her home sell as she is living in an assisted living facility and desperately needs the money from the sale of her home to pay for her living expenses at the facility. This process has been going on for six months and I have called the company several times and no one will ever get back to me. They are not doing their job and my moms health is dependent on the selling of her home to be in a place that can care for her. They are very evasive of my questions and are saying that my mom owes them money that does not match up to the amount on the statement she received. Everything just feels very wrong with this company. I am just trying to focus on the care of my mom but they are standing in the way. I need to be able to have someone to contact and to warn others of this company. An offer was submitted to me via email handwritten on yellow legal paper with no official document.

      The person making the complaint has omitted a number of key facts regarding the sale of this home. First, is the very nature of selling a home requires a willing buyer and willing seller. The pool of buyers in **** is traditionally smaller in the fall and winter, which is no exception for manufactured homes. Additionally, the home itself is one of several in the community and is not the newest or in the best condition. The homeowner was a smoker and that smell and residue still remains and the seller has been unwilling or unable to remedy those issues. A great deal of the feedback Greenlawn received from prospective buyers was that it was too costly to renovate in addition to the price and that the home was too big for their needs. Also, Enchanted Acres is a 55 and older community, further reducing the pool of buyers and making renovations even harder since they would be unlikely to do it themselves.

      Despite these factors, Greenlawn's staff cleaned the home and has staged it in a manner to try and optimize its marketability. A before and after photo is attached and are just some of several showing the difference from when the seller engaged Greenlawn and when it was shown to interested buyers. Greenlawn has shown this particular home on at least a dozen occasions over the term of the listing agreement. Calendar entries showing 10 of the showings are attached and this does not include the showings where the buyer looked at multiple homes or it was shown on the spur of the moment. In three separate instances a prospective buyer has made an offer to purchase the home; albeit at a number less than seller's asking price. In each instance the seller has rejected the offer and refused to make a counteroffer. A seller who is unwilling to engage in negotiations creates an additional challenge to Greenlawn in accomplishing this seller's desire.

      Further, since the filing of this complaint seller has notified Greenlawn that she does not wish to renew or continue the listing agreement at its expiration on January 31, 2025. She and Greenlawn have been in communication regarding returning the title to the home, the keys, etc. to her as well as Greenlawn removing the listing from its website and signage from the home. Seller has refused to accept Greenlawn sending the title directly to her and the parties are in discussion on alternatives 

      Greenlawn regrets that the buyers presented to seller did not meet her needs, but as a broker Greenlawn can only work with what is given to them in terms of potential buyers, the condition of what's being sold, and the seller's willingness to work with those buyers. Greenlawn only gets paid on the listing if and when the home sells, there is no benefit to Greenlawn in delaying that. The community owner gets paid its rent regardless of the home being owned by this homeowner or a new tenant, and in fact would be paid more by a new homeowner. Greenlawn cannot create a buyer for the seller and cannot force the seller to accept offers Greenlawn does receive.
