This company is building an apartment building on ********************* called the *************************. They bought property next to our businesses and have been a nuisance for the past year. First, they were tearing down the old buildings with signs stating asbestos and did not let us know the plan so we could shut our windows and doors. Since then, they have taken over the front of our business, tearing up our grass and parking in our parking lot, and running big construction trucks in our lot. There is so much trash all over our property. I'm out here cleaning every day when they should be taking care of this. I have had my cleaners cleaning our space double since they started construction. They have debris, installation boards, and trash flying off the building. One board flew off the building and almost hit me, as you'll see in the picture. I tried to post the video here but wont allow me. I have video and pictures of all of it. This has been very dangerous, and we have tried to work with them, but they continue to ignore us, even though they say they will fix it, but they have not. I have documentation of pictures, videos, emails, and text messages of all of this going on for the past year. They are illegally parking and taking over the roadway and our businesses. I am struggling to grasp why this company persists in undertaking construction activities without prior notification. Im sure your company has several complaints from numerous jobs that they get away with it. Im not the one to be quiet about this issue. Unfortunately, several vehicles on our premises have been damaged as a direct result, and our customers are expressing their dissatisfaction to me on a daily basis. The ongoing construction has resulted in significant financial losses for all 3 businesses over the past year, as potential customers are deterred by the ongoing disruption.Business Response

Thank you for reaching out to let us know that Mr. ***** ******* has filed a formal complaint. We addressed Mr. ******** concerns in a review that he submitted in December to the BBB as well as through our ****** Business Profile. Our communication with him has been consistent in both formats. In December we responded with the below:
We understand you are the tenant in the building next door, but not the property owner. The property owner has not reached out to indicate they are not happy with the efforts we have made to keep things clean, which is ongoing and daily and cant be done to perfection given the complexity of the job site and shear number of people on the jobsite. The parking of people on the street is in the ROW, it is not in the parking lot of the property owner where you rent space, again we have not had complaints from the property owner. We understand its annoying and can assure you that we email all the time trying to get people to stop parking in undesignated areas. However, we are not allowed to tow from a ROW or property we do not own. Your best solution is to call the police if you feel someone is parked illegally. Any damage to adjacent property that is caused by our development, will be fixed as we near completion and communicated as such with the property owner. We do understand development is not easy on neighbors where ever it occurs, but we are doing what we can. The road closure is fully in compliance with the city and county approved plans and a flagger is not required by the city or county. We can also assure you that the signage for the removal of asbestos was done in full compliance with regulations, and then the removal itself was done by a company that is specialized and licensed to do so. We will continue our efforts to keep it orderly but it is not perfect nor are other developments in urban areas.
We would like to note the city has not fined us for anything he has commented on and our office has not received complaints from other businesses nor the owner of the property that Mr. ******* occupies. Since December, we have continued to not only clean up, but did repairs on the neighbors property. We are nearing completion outside and have further cleaned up and pulled down barriers. This complaint is without merit and we would like it removed, considering we have addressed and continue to address his comments in all forms. We have done nothing wrong, we understand Mr. ******* doesnt like what it means to be next to a construction site in an urban area.We will continue to do our absolute best to keep the property clean while we are finishing construction and will continue to place an emphasis on cleanliness upon the opening of the property. The two phots attached were taken this morning on 3/4/25

I reject this response because it contains inaccuracies. Although construction is almost complete, our building's three businesses have faced disruptions for over a year. Our landlord has maintained open communication with you throughout this period, and we possess comprehensive documentation. I find it puzzling that you continue to highlight our lessee status, implying that our concerns are insignificant. Several businesses on the street have filed complaints, but only after my persistent efforts did Preferred Living begin to comply. This behavior is unacceptable. Instead of disregarding lessees, consider personal communication to inform us of potential disruptions, enabling us to notify our customers. Your actions have resulted in considerable business losses.

Per prior communications, this was and is a construction site, operating with all proper permits and complying with the city as required for road closures, asbestos removal and the actual construction. Correct, our office has not received any sort of written official complaints from other businesses or notices from the city or the BBB outside yourself. We have attempted to keep the area as clean as possible knowing at times this is a challenge and not perfect, some weeks were harder than others based on the volume of work happening. As of 2 weeks ago, the road is fully opened, paved, landscaping, and the property is open and beautiful while still finishing inside and some exteriors on the west and north sides. There was no way to get to this point, without some mess that requires constant daily attention. We are sorry this was upsetting, but the city approved this project as there is a need for housing.Initial Complaint

While we can certainly appreciate your
frustration, we want to ensure you that the team on site is committed to
rectifying this situation for you. We have 2 documented instances of this
occurring and have addressed it both times. We have taken further action in our
policies with maintenance staff so that this can be addressed timely when
onsite staff is not present after hours.
Instance
occurred because a resident’s guest parked in the spot. The resident was
contacted immediately, and the car was moved within 10 minutes.
Instance
occurred on Saturday, March 16th. Leasing team contacted the
resident in violation and emailed them asking them not to park in your
spot clearly stating that it would result in their car being towed.
We understand that you had not yet seen the email
sent by our team when you came in on Sunday to notify us. We then explained to
you that the resident had been emailed the day prior. To further address the
situation, our manager sent another email to you on Monday March 18th (Below)
Hi,
Thank you for making us aware
of this situation over the weekend. I understand you have already been in
contact with ****.
The resident that was parked
in your spot has been made aware of the situation & has been instructed not
to park in any permit only parking spot that they are not renting. Our Resident
Manager has been instructed to have any vehicles towed that are illegally
parked.
If this happens after-hours
again in the future, please call the After-Hours Emergency Maintenance line and
the vehicle will be towed immediately. Feel free to reach out to the front desk
with any questions or concerns.”Customer Answer

I gave them monies for an apartment. I was rejected. I asked prior to this if they rejected me when would I get my money. They said immediately and that they accepted my situation. they said yes.
They said I’d know Monday. It was Wednesday.
But they refused to put money back on my card. Would not give me a date when check would be mailed or a contact to find out.
I was told check was cut 27th it’s the 1st. I don’t have it.
I have emailed and texted so many times. They ignore and I still cannot get an answer as to when it was mailed.
It’s ridiculous .Business Response

Hello *****,
We respectfully disagree with you in the matter regarding
a refund to you.
On March 18th when you applied for the apartment at
Taylor House you paid via ***. On Tuesday, March 21st a rental verification
revealed information that caused a denial. A refund request by the manager was submitted on Monday, March 27th, as
there is a waiting period to ensure the original payment does not get returned
*** from the bank. We offered to hold the check for you at our place of
business for pick up. That offer was refused.
We then placed the check in the mail on Thursday, March
30th. We do not believe this is
excessive considering the law allows up to 30 days.Customer Answer

[If you do not say why you are rejecting the company's response, BBB must close your complaint.]

I am rejecting this response because: They finally returned money after lying in writing several times. They owe me $108 more. This has been ridiculous
