    I have a couple of issues with the fence he installed he actually came out and looked at the problem and came back but he didn't have what he needed to do the job and never came back I call him a few times he say he will be back no call no show a few times

    We also had an agreement with Kennedy's Custom Deck to demo our old deck build our new one. We gave Kennedy a certified bank check of $12,500 for the deposit. The total cost was to be $15,900. We gave him this check on 9/14/2020. Over 2 1/2 yrs. ago. The demo guys came out in the next day or two and demoed our old deck. Kennedy came out 11/12/21, 14 mos. later, and partially framed up the new deck.. On 10/8/2022 he came out to pull the weeds that were that were growning up between the deck joists and haven't seen him since. There were many days he said "I'll be there tomorrow" or mentioned a day when he'd be here but never showed up. Communication was slim to none.In the few random calls and texts my wife got from him we heard every conceivable excuse in the book of why he's not finishing our deck and lies about when he will. Per his ******** web page we see he is building other peoples decks and fences though. He texted my wife a few days ago and gave her a 15 minute sob story and said he had no money. When she asked where ours was he replied "I don't know". We've been overly patient with this guy and our patience has run out. We're tired of staring at a pile of warped boards laying on our patio that we can't use and a partially built deck frame also with warped boards from the weather. We also want either our deck finished or our deposit returned.

    I entered into contract for deck in 9/25/22 with *** owner of Kennedys custom deck. He asked for $2000 to begin framing of the deck. The framing was delayed because of permits and insurance per ***. He showed a total of maybe 4 days working a few hours from Oct and November. Once framing was completed he was given a check for $6000 to purchase materials. *** had begun the job in the fall and he assured me it would be completed in a week and he works during the winter. It is now almost 8 months later and no materials for the decking have been delivered. Dates were given to come and finish by him and then he would not show or call. I received a text I got a text 12/21/22 stating he and his guys are organizing his shop to be ready to work outside when the weather broke and he had been completing small fence jobs. 2/12/22 I texted him and daily texts after that. He replied 2/15 saying he’d be here end of week, and did not show nor responded till 2/26. I received a text from him 3/29/23 after I made multiple calls and texts that materials would be delivered on 4/3/23. Materials did not arrive and *** is not returning calls, texts or FB messenger messages. I am asking for assistance as I have an unsafe yard with framing, two deep holes and step framing unattached and leaning. I have been patient and trying to be understanding but this is going on too long, I need my money refunded so I can find another contractor and purchase the decking.

    A contract agreement between *** ******* and ******* ****** to build a deck and overhang porch took place on 9/8/2022 for a total cost of $40,000. He wanted us to put down $20,000 but we did not feel comfortable with that and an adjustment was made to the contract and we gave him $12,500 on 9/8/2022. He cashed the check the next day. Nothing else was changed as far a deck measurement of porch overhang. The start date was suppose to be on September 7th, 2022. He then changed the start date to September 26th, 2022 because he stated that he had to pay for registration, handle workers comp and he owed $2,400 as a registered contractor. August 30, 11;34 it’s official he stated I’m registered with the county. Should have city zoning permit back by the end of the week or by Thursday. Once he had permits, registration fee paid, he started on the deck September 29th, took 6 hours to remove old deck. September 30th spent 3 hours removing 3-4 pads. He came back on the week of October 10th to dig 3 holes and remove 3 sonnet tubes which took him 3 hours. The start date and time line was September 26th 2022 and job start to finish should take 2 weeks according to the contract. He only showed up for 3 days after September 26th and that is it! This deck and overhang porch should of been ***e by October 14th, 2022 completion of job according to the contract. There were many days that he said I will be there tomorrow, and never showed up. I even sent him a 10 day forecast on days that he could have been here to move quicker on this job and did not show up even on those nice days. He always had an excuse on why he did not make it. My wife and I had to have a serious conversation with him that we were not satisfied on the days that he has only show up and the only thing we are seeing is deck removed, 3 holes dug, 3 pads removed between September 26 to October 24th. We are willing to pay him between $1,500-$2,000 for 12 hours of work and have him send us a certified check for $10,500.

    On November 13, 2022 we sent you an email asking for our funds (down payment) to be returned.  Out of the $12,5000 (down payment) we asked for a certified cashier check ($9,500) to be sent to our mailing address (PO Box **** ******** ****** **** *****).  We thank you for returning our email on November 12, 2022 @ 7:49 PM.  After responding back to your email, you wanted to keep $4,000 for some of the work that you have done, and my wife & I agreed to that request. You mentioned in your email, "I'll give you 5K this Friday (November 18,2022) & then the rest in two weeks (December 2, 2022). We responded back by stating, “we feel this is a fair proposal." These two checks are to be mailed to PO Box **** ******** ****** ** *****. We still have not received those funds. You mentioned,” that you do not have a cent to your name from the last email I received on November 26, 2022 @ 7:58pm.  They took my account 3k negative and I had to close it. But besides that, with money I really don't know where money went”.

    The Akron Better Business Bureau has tried to contact you twice but you have not responded in resolving this situation (Jennifer Skidmore/Investigator & Dispute Resolution Coordinator). You mentioned that you have a debt collector that can see your bank accounts and the checks you deposit. They can see all the names on the checks. They have sent out letters asking them to pay them when job is done and not you. It's actually a suitable case you stated.  But, said, “they were going to send Sherri (my wife) a letter stating to have the check in their name and not your name.” We never received a letter from them. The check of $12,500 was cashed on September 9, 2022 and you wrote us a receipt for $12,500 on September 8, 2022.

    We have been advised to carbon copy all parties that I have been in contact with so they know about the situation more in detail.  As mentioned before, I am willing to contact all parties that know knowledge of concerning this situation and letting them know that this has been resolved with the proper funds ($8,500) returned back to us as a settlement in a certified cashier check and sent to our mailing address. Mr. ******* & Ms. ******* (registration department/summit county), when this goes to civil claims court, I will provide you with a case # ASAP.  Our Attorney is in the process moving forward with the Stow Municipal Court System & filing the proper paper work and documentation.

    Signed a contract on 5.15.22 for a small deck that *** advised would take 3 days. 1 for demo and to pour concrete and 2 days to build the deck. He established the installation date of 5.27. $3000 was paid via check on the day the contract was signed to cover materials and initial labor with the remaining $2000 balance to be paid upon completion. We had 811 Dig out to mark service lines and awaited the start. *** said he would remove the old deck and pour concrete before the start date, this didn't happen. Sent msgs on 5.24, and 5.26, no response. I msgd on 5.28 and was told he was "two weeks behind". Msg on 6.5 asking about a new start date and advising we were going to be out of town from 6.19-6.24. No reply, msg again 6.8 advising I was concerned about no contact. He gave a story about a lost employee blaiming him for being behind. I said the following week would be fine. I got a commitment to have the job started by the 18th, he confirmed yes it'll only take two days. I msged on the 17th no reply, no call. Tried again on the 24th, no reply, again on the 25th, no reply. Tried again on the 26th asking for a refund, he finally responded saying he was working on a deck he took a deposit for on March 15th. Again, I asked for a realistic start date, he said he would follow up on the 26th to give a date. No msg, I reached out on 6.29, no reply, again 6.30 asking for a start date, he said he would give us one but didn't hear from him. Msgd on 7.4, no reply. Another on 7.5, no reply. He advised on 7.6 "will be there 18th and 19th" and will be on Sunday the 17th to "dig and pour". On the 17th he advised that he would dig and pour on the 18th because of the rain. 18th was raining so confirmed 19th start, he replied yes. It didn't happen. Told me he'd be on-site by 9a on 7.20, and didn't show. One excuse after another. The ignoring of communication is incredibly unprofessional. Contract and text record available if needed. I want the deck or deposit back.

    The deck was finished. I would consider it resolved. Either way is OK with me. If we could just close it that would be best so others can see the complaint and know what this company is all about. 

    The owner told me the original business is "closed" now because of some kind of fraud, so he had me re-write his check in his personal name instead of the business. I'm not sure if that info is useful or not but wanted you to know.
