      ****** ********* was my landlord while I attended law school at the University of Dayton. The monthly rent was $860, which was also the amount paid as a security deposit. Upon termination of the lease, Mr. ********* returned my deposit with an itemized deduction list; however, the deductions were significantly inflated. Of my original $860 deposit, Mr. ********* returned a check for only $122.95. His deductions are as follows:

      (1) plastic film removal from the windows: $24.00
      (2) paint cost of spot painting bedroom #1: $89.22
      (3) labor cost of spot painting bedroom #1: $96.00
      (4) paint cost of spot painting living room: $133.83
      (5) labor cost of spot painting living room: $144.00
      (6) legal fees incurred by Mr. *********: $250.00

      These deductions are fraudulently inflated and the "legal fees" are non-deductable. The apartment is a relatively small living space that is significantly worn down with haphazardly plastered walls and a poorly painted floor--details Mr. ********* markets as "renovations." There is simply no possible way that spot painting a few nail holes with eggshell white paint cost $233.05 and required $240 worth of manual labor. Additionally, small, repaired nail holes that I repaired myself before leaving are not considered "negligence," as Mr. ********* claims, but rather normal wear and tear associated with a two-year tenancy. Finally, there is absolutely no reason by I should be liable for Mr. *********'s legal fees.

      Mr. *********'s dishonesty reflects poorly on him and his business, as his online reviews indicate that he has a habit of not returning security deposits or making unreasonable deductions. The premises were left in excellent condition with only minimal wear and tear from my two-year occupation of the apartment.

      In return, I would like a significant portion of the withheld deposit returned to me, with only fair market and reasonable deductions kept for Mr. *********.

      ***** ****** rented the property located at *** ****** *** **  The monthly rent was $860 and the security deposit was the same. 

      An itemized deposit refund statement was provided to ***** as he states in his complaint.  ***** falsely states “the deductions were significantly inflated”  Further more, he states “There is simply no possible way that spot painting a few nail holes with eggshell white paint cost $233.05 and required $240 worth of manual labor.”

      Since this is the bulk of what ***** is contesting is the paint and labor costs we can address this first.  Please see the Itemized deduction PDFs provided by ***** in this complaint.  It is stated within these documents (as well as by his own admission within the complaint) that Lessee (*****) spot painted nail holes he caused during his occupancy. 

      ***** falsely characterizes the deductions (2, 3, 4, and 5) in the complaint by claiming the walls were spot painted BY THE LESSOR after he vacated. The attached documents clearly state the walls needed repainted in their entirety DUE to lessee (*****), spot painting the walls.  This should clarify why the costs are as stated in the documents and within the complaint are fair market and reasonable deductions.  Furthermore, within the documents provided by ***** one can see that causing any kind of damage to the walls, and painting or permitting painting of any portion of the premises is in direct violation of the lease. (see the citation provided in the document ***** provided)

      The “Legal Fees” portion of the Deposit refund statement are professional costs incurred to write professional letter of correspondence over a period of time informing him of his lease responsibilities.  This was required because ***** was attempting to break his rental agreement 3 and a half months early and skirt the financial responsibilities he agreed to in the lease agreement.

      Because of the real costs incurred by the lessor related to damages directly in violation of Lessee's Lease Agreement no additional refunds should be given to *****
