On August 27, 2024 I came home to find damage to my backyard landscaping as a result of work done by Farmore Roofing on the garage that backs up to my patio. I contacted ******* ******, owner of Farmore Roofing, who understood my concerns and scheduled to meet with me the following morning, August 28. After reviewing the damage ******* agreed to remedy the situation and indicated he would pay for a portion of the landscaping cleanup, caused by his employees, once I obtained a quote. He indicated I had his word on this.

I shared the landscaping quote with ******* on September 7 via text for $270. On September 9 he replied saying he’d pay $170 of the bill. I accepted his offer via text but did not receive the reimbursement. On September 20 I followed up with a phone call and text. He indicated I should re-send the quote and my address and he would be mailing me a check within the next few days. On October 15 I texted him again letting him know the work was now completed and I sent a copy of the paid invoice. No response has been received to date.

I’m requesting that ******* ******’s commitment to pay $170 towards the cost of cleaning up my yard from the property damage sustained be honored.

Thank for reaching out again ****.  Nice to hear from you.  So what actually happened is you allowed YOUR ivy to grow inside of your neighbors garage. To the point it created damages to her garage.  So all we did was remove it from her garage.  You then called the Police who came over and told me that we did nothing wrong.  Then you called the City of Cleveland who then also told me we were doing nothing wrong that you should have not allowed it to over grow like that.  And we only cut back what you allowed to grow inside our customers garage nothing more.  We even pulled a Permit then proceeded to pass our inspection.  And you are right I was going to pay half of your landscape bill but because of your rudeness I decided against it.

I am rejecting this response because:
The issue regarding the ivy and other debacles associated with
this job have nothing to do with the integrity of your word as a business to
take responsibility for property damage caused by your employees, and, honor a
    commitment to reimburse me.
There were many issues at play with
the professionalism of your crew that led to the circumstances of the police
and councilman being called.  I chose not to focus on those issues as
you agreed they were teachable lessons that you could use to enhance your
businesses’ customer service, and avoid future issues.  As we have
discussed, the ivy growing up the back of the garage on the side of my property
pre-dated the purchase of my property and I had the previous garage owners
blessing, so it is a moot point as it relates to this
discussion.  (The picture you attached is NOT the back of the garage
that faces my property. I have attached correct photos of the landscaping clean up that I had done for the ivy,
including pruning damage to other shrubery).  However, the property
was purchased by a LLC about 3 years ago and has remained vacant ever
since. So I was NOT made aware there was EVER any ivy growing on the
inside of the garage. As shown in the pictures, ivy was not only cut back from what you said grew inside the
customer’s garage but on the entire back of the garage facing my property.  And as far as the permit, it was NOT pulled prior to the work being done and was
only pulled AFTER THE FACT once the Councilman’s office got involved and ceased
your company’s work until permits were properly obtained.
     The police and councilman
were called PRIOR to your committing to pay for the damage to my property that
you acknowledged was caused by your employees.  The call to the
police is how I actually obtained your phone number.
The principle of the matter and focus of my complaint is on the
integrity of your word and company after acknowledging the damage caused to my property.
It is the reputation of your company that is in question, not the excuses you
have relied upon for not honoring your word, or the lack of courtesy you showed
by not responding to my last four text messages after agreeing to pay $170 of
    the landscape bill.

Once again I will address this keep rejecting and I will keep writing this.  You called the police on my guys for doing their job.  They did exactly what they needed to do to complete everything that OUR customer paid us to do and the Police officer that I spoke with agreed with me.  As far as damage that you claim we caused there was none.  Your tree branches were growing onto the roof and we had to remove them.  And by law anything growing from attaching yards is our problem to deal with.  So again you allowed your tree to grow onto your neighbors garage and damage her roof.  We are allowed to remove it along with the IVY.

As far as my integrity as a man and a business owner.  I agreed to pay some of YOUR landscape bill because I felt it was the right thing to do. We did nothing wrong but I was going to do it out of the kindness of my heart NOT because I owe you anything because I do not.  You then complained to the inspector about us and did nothing but bash our name to him.  I know this because he called me to tell me the vile words you spoke.  This was after we (you and I) came to an agreement.  I even came over your house.  My kindness for individuals like you is none.  I will not be paying anything.  And if you keep on making these complaints and slandering our name for I will take you to court.
