      Thu, Oct 31, 8:27 PM to ************* THE ORIGINAL CONTACT IS IN AN ATTACHMENT. THIS IS WHAT FOLLOWED:

      MR. MILLER SAID HE WOULD GET RIGHT BACK TO ME BUT DID NOT UNTIL AFTER i CALLED HIM FRI AFTERNOON.

      WHEN DID RETURN MY CALL HE TOLD ME THAT THE OPERATOR ASKED IF WE WANTED THE SOIL DUMPED THE WAY HE DID IT. HE WAS ALREADY LOADED AND BEGAN DUMPING WITHOUT EVER SPEAKING TO US.

      MR. MILLER SAID THAT THE OPERATOR IS ONE OF THEIR BEST AND IT WAS OUR FAULT FOR NOT STOPPING HIM. THAT IS LIKE TELLING SOMEONE HIT BY A CAR IT IS THEIR FAULT FOR NOT STOPPING THE CAR BEFORE IT HIT THEM.

      HE ALSO SAID WE OVERLOADED OUR TRAILER. WE STOPPED HIM AS SOON AS WE COULD. HE WAS TOLD TO GIVE US TWO YARDS OF SOIL WHICH I WAS TOLD WAS 1500 LBS PER YARD OR 3000 POUNDS WHICH IS WHAT OUR TRAILER IS RATED FOR.

      THE OPERATOR ALREADY HAD THE SOIL LOADED READY TO DUMP WHEN WE GOT TO HIM.

      *** ******* came into the gravel pit to get topsoil. He asked
      for two yards. Our loader operator scooped two yards in the loader bucket. *** ******* has ramps on his trailer. When the loader operator indicated to *** ******* to lower the ramps, *** ******* told him to just dump it. Our loader
      operator slowly dumped it, since the ramps that *** ******* refused to lower
      limited how low the bucket could get to the trailer bed (approximately six
      feet). After slowly loading the trailer with two yards, *** ******* left. It
      was not until later that day that *** ******* called in claiming his trailer
      was damaged due to overloading. Any customer coming in to pick up material
      resumes responsibility for what their trailer limits are. The loader operator
      does not get out and inspect the customer's trailer for load limits, as it is
      not our equipment. That responsibility falls upon the customer, since it is
      their trailer.
      We
      feel bad for *** *******'s situation, but we can not set a precedent that we
      are responsible for any damage to equipment, when we loaded exactly how the
      customer asked us to.

       As I stated earlier in my original complaint, the operator NEVER spoke to either my wife or me.  He just started to dump the soil until my wife and I waved him off AFTER it was too late. 

      We NEVER had this issue at the 322 location with the same trailer. There the operators actually spoke to us and were careful to lower the bucket to a reasonable and safe level before unloading soil into our trailer.

      Apparently the front office told the operator we were on the way and were to receive two yards (within the capacity of the trailer), because he was waiting with a full bucket and began to dump the soil once we got there.  He NEVER spoke either of us.

      We cannot prove it, but our son, who works construction as a supervisor, told us that the trailer was also overloaded.  AS I stated in the original complaint, I was told that that location went by volume (yards) not weight and a weighed 1500 lbs.  And being one of their “best” operators, according to ****** ******* he would know h0w much to have given us if he cared;
