I hired Parks Tree Inc. to level a plot next to my home and to put new dirt atop the land. I contracted with the company in March for a cost of roughly $8,400. The contract called for three workers for a total of 75 hours — 25 hours per man. I'm less concerned about the man-hours; I'm concerned about the fact Parks Tree, which scraped the old dirt, put dirt filled with rocks as a replacement. The land isn't level and unsuitable for my use, and I talked to an employee who told me I'd incur an extra cost for any additional dirt. Frankly, the company didn't order enough dirt, which they were obligated to do, even if that meant a higher cost to me in the initial agreement. I contracted for a "level" plot; I don't have a level plot. And if I take what a representative of Parks Tree says as gospel, I'm out of luck if I expect the company to fix the problem. The land needs to be leveled with good, rock-free dirt.

    Business Response

    Date: 05/25/2023

Parks Tree Inc. went to the clients property on Friday, March 3, 2023 for a free estimate.
Client asked for pricing on leveling the lot next to his house, as well as pricing for seed
and sod options. Over the next month, our landscape manager spoke several times with
the client and adjusted the estimate to his needs. His final estimate was accepted on
March 17, 2023 and was to level the yard with 18 yards of soil and 75 labor hours to
install it. Client chose not to do any seed or sod at that time. Client made a down
payment to secure the schedule on March 21, 2023. Client was scheduled for work on
May 10, 2023. We arrived at the property and removed the current weeds and sod. We
had 18 yards of super soil delivered to the property, and spread it across the lot. The lot
used to have a house on it, and it was explained to the client at the time of the estimate
that the dirt will settle over time as the ground settles from the foundation of the old
house. The entire 18 yards were installed on the lot per the invoice with the client. The
client never expressed that they were unhappy while we were on the property. The client
called our office, and was wildly rude to our staff about his unhappiness. The landscape
manager and landscape foreman went to meet the client at the property to discuss what
he is unhappy about. It was discussed with the client on May 13, 2023 that the invoice
was completed, and that Parks Tree Inc. would provide mulch 4 yards of black mulch
FREE OF CHARGE. We also provided the client with a bag of seed to put down FREE
OF CHARGE. We explained to the client that a field of dirt is only going to collect and
attract weeds. We installed the bag of seed FREE OF CHARGE as well. At the time of
that meeting, the client agreed that the invoice was completed, and any additional work
would be on a new invoice. The additional work would be 6 more yards of dirt, and
Parks Tree Inc. would only charge the client for the material, and not for the labor or
machine to install it. The client was also provided a discount on the dirt, as they stated
there were stones/rocks in it. When asked to see the stones the client removed- to
provide a picture to the supplier, there were no stones.
Yet a discount was still provided by the supplier on the additional yards. The client was
unhappy about having to pay for the material. Parks Tree Inc. general manager called
the client, and offered the additional materials for FREE OF CHARGE as well. On May
23, 2003 the client was provided an additional 6 yards of super soil, installed on the
property. There were no stones/rocks in the dirt.
In closing, the client paid for 18 yards of super soil and 75 labor hours.
In the end the client received 82 labor hours, 24 yards of super soil, 4 yards of mulch,
and one bag of seed installed. Parks Tree Inc. went above and beyond for the client to
rectify the situation in a timely manner.
