    Business Response

    Date: 05/05/2023

    May 5, 2023 Response to Complaint ID #: ********

The complainant and his wife originally contacted our firm in 2017 about assistance and representation relating to an IRS audit of their 2014 and 2015 federal income tax returns. The returns being audited by the IRS had not been prepared by our firm. The complainant and his wife signed an Engagement Letter with our firm describing the services we would provide related to this project.

In late 2017, upon completion of the IRS audit, we finished the work we were engaged to perform. We were not engaged to perform any other work. However, we informed the complainant and his wife that their 2014 and 2015 Ohio income tax returns would need to be amended to reflect changes resulting from the IRS audit and that they would owe additional taxes with these amended returns. This was a recommendation from us; we were never engaged by the complainant and his wife to prepare these amended Ohio returns.

After repeated attempts to obtain copies of the originally-filed Ohio income tax returns were met with no response from the complainant, on 1/18/2018 we emailed Ohio TBOR-1 forms to the complainant and his wife and asked them both to complete the forms so we could contact the state of Ohio on their behalf (a TBOR-1 form allows members of our firm to represent clients before the Ohio Department of Taxation). We never received signed TBOR-1 forms from the complainant and his wife, nor did we receive copies of their 2014 and 2015 Ohio income tax returns.

After tax season, on 5/10/2018, we attempted to contact the complainant and his wife via telephone. Our call was not answered, and we were unable to leave a message as their voicemail box was full.

On the same day, we called the Ohio Department of Taxation’s ‘Tax Practitioner Hotline’ and requested 2014 and 2015 transcripts of the complainant and his wife’s Ohio income tax returns be sent to their home address. We were unable to directly receive copies of this information, because we never received copies of signed TBOR-1 forms.

On 6/1/2018 we again contacted the complainant and his wife and left a voicemail informing them we still needed signed TBOR-1 forms, their previously-requested Ohio income tax returns, and copies of the tax transcripts sent by the Ohio Department of Taxation to their home. We did not hear back from the complainant or his wife.

On 6/28/2018 we once again called the complainant and his wife, were unable to reach them, and were unable to leave a message because once again their voicemail box was full.

On 7/10/2018 we, yet again, contacted the complainant and his wife and left a voicemail informing them we still needed signed TBOR-1 forms, their previously-requested Ohio income tax returns, and copies of the tax transcripts sent by the Ohio Department of Taxation to their home. We did not hear back from the complainant or his wife.

On 7/26/2018 we sent an email to the complainant and his wife requesting the Ohio tax transcripts sent to their home address two months prior and noted that we had received no responses to our repeated voicemails.
