      On March 10, 2016 we had a hail storm and I contacted my Home Insurance, Cincinnati Life and started a claim. An adjuster made the decision that I did not have any damage to the roof and denied the claim. I recently had 3 roofers come and give estimates and 3 said that I had hail and wind damage. I changed ins. companies to Auto Owners and after a wind storm in March of 2020, I called and reported several shingles being blown off of the roof. They too, said that I had hail damage from previous ins and that they would only pay for $149 after deductible for the wind damage. All 3 roofers have said that insurance should be paying for both instances, hail under Cincinnati and wind under Auto Owners. I called Cincinnati and they sent down an adjuster and a forensic engineer to inspect the roof. They both agreed that the roof needed to be replaced and that Cincinnati should pay for the damage in 2016. The engineer said that the damage happened in 2016/ i received sword that Cincinnati was going to deny the claim again because I did not send in a refuted within 2 years of the initial denial. I took it that I did not have damage each time and depended on the adjuster to be the expert in this matter. I do not go up on the roof every time there is a storm. I have replaced several shingles for the wind damage. I have sent a rebuttal to both companies. I just want the companies to pay for the replacement of the roof. That is why I have insurance. No one informed me about a 2 year statue of limitations to refute a claim. Please investigate for me. i have a copy of the engineers report

      The Cincinnati Insurance Company (“CIC”) has received your letter of October 3, 2022,
      regarding a Complaint filed by ****** **********.

      The complainant did not file a claim with CIC until September 1, 2022. Unfortunately, the loss
      was reported outside the two years from the date of loss limitation. *** ********** was
      advised of same at which time he notified us of a claim he filed with a date of loss of May 10,
      2016, which was denied for no storm damage found on July 13, 2016. We are providing a copy
      of the denial letter for this loss as it was not reported within two years from the date of loss.

      Problem:
      This is in regards to case # ******** and ********. After talking to my attorney I just wanted to add to my rebuttal letter that My statute of limitations was tolled by my inability to discover the damage to my roof in 2016, that was found by an expert provided by my subsequent insurance company, otherwise I would have rebutted the claim earlier. Thanks again for relooking the claim. i am not an expert in hail damage and when the inspector from Cincinnati Life came and told me that i did not have damage i took him at his word. This is why i have insurance, to send qualified persons to give an honest inspection and to pay claims when submitted. I did what I was supposed to do in calling and reporting hail damage when I thought I had it and everyone around me did. We did not have any other storms that could have produced hail or wind until 2021. Then I had a roofer come and inspect for wind and he said that i had hail damage as well. Calling Cincinnati again to come and look, they sent a forensic engineer and she said that the hail damage occurred in 2016 and the adjuster agreed. She said that the claim should be paid but when higher ups looked at it they denied it based upon the fact that i had not responded within the 2 year window. I have since replaced the roof and the amount it cost would have been minimal to the company but to me in this day an d time is big. Please look at this again and pay the claim.

      Dear *** ******:

      The Cincinnati Insurance Company (“CIC”) has received your letter of October 17, 2022,
      regarding ****** **********’s additional concerns regarding this case. Specifically, ***
      ********** claims that the limitation period in the policy was tolled by his “inability to discover
      the damage to [his] roof in 2016 that was found by an expert provided by [his] subsequent
      insurance company… .”

      As noted in CIC’s response dated October 5, 2022, *** ********** originally reported a claim
      with a date of loss May 10, 2016. This claim was denied on July 13, 2016, because an
      inspection revealed no storm damage. *** ********** later reported a claim on September 1,
      2022, again claiming that the damage to his roof occurred in May of 2016.

      The policy of insurance issued to *** ********** by CIC specifically requires claims to be
      reported within two years from the date of loss. This period is not extended by any claimed
      failure to discover the loss. Because *** ********** did not report his claim for over six years
      after the date of loss, it is not covered by the terms of the policy.
