    Subject: RE: ******* Consumer Complaint

    June 15, 2022

    Dear Sir/Madam:

Around the 1st of April a representative of **** Contract Services contacted Hensel Ready Mix about a surface issue with a driveway that he poured in July and August of the previous year. Hensel Ready Mix informed **** that we would send a quality control representative to the site which we did on April 8th of last year.

The quality control rep took pictures of the driveway and also took Swiss hammer tests on the concrete and reported back to ****** Hensel the owner of Hensel Ready Mix. At that time Mr. Hensel contacted **** Contract Services to discuss the matter and he told the **** rep that our quality control rep had witnessed what appeared to be fertilizer on the driveway from the yard which could have contributed to the surface issues and that the strength of the concrete tested fine. At that time Mr. Hensel informed the **** rep that most surface issues are more related to pour placement procedures than faulty concrete.

Then Mr. Hensel told the **** rep that he would be willing to replace the worst section which was located next to the road if he paid to tear it out. It would have been approximately 10 yards of concrete or less and if he wanted to do more than that he would have to pay to get it cored and have a petrograph by a certified lab to determine whether the concrete met specifications and what actually went wrong. Mr. Hensel believed the burden of proof was on the buyer since we test our concrete constantly for air entrainment and strength.

In the meantime, **** moved out of the state, and we didn’t hear anymore about the matter until the first week of June when a rep of **** called and put the full amount of the driveway on to repour and informed Hensel that we had agreed to replace the whole driveway.

Mr. Hensel then told the **** rep that there was no way that he would have agreed to that and told **** that he was supposed to have it petrographed to see who was at fault. The **** rep then became argumentative and hung up on Mr. Hensel.

In closing we feel that we sold **** Contract Services a quality product and that the fertilizer from the yard played a part in the surface issues and that our initial agreement with ****, was to replace one load next to the road where a lot of the damage occurred. Even if we agreed to replace the whole driveway it would not have cost the $12,000 that **** is asking for. Along with this explanation of the events we will be emailing delivery tickets and pictures from the site. If any more information is needed, please feel free to contact us.

    Thank you,

    ****** Hensel, President
