    I received a text from the owner ******* ******** suggesting his company is no longer responsible for fulfilling the contracted work for which his company was hired and paid in full. His company was hired to construct a 24' x 36' foundation with footers, a driveway apron, a driveway, 10' x 10' hot tub pad, French drain, cement area to connect/cover the underground electrical work for the hot tub with cement, and a half acre pond.
    I reached out to him after receiving a text on Wednesday, May 28, 2025. I did not hear back from him.
    We had two contracts, including the pond and cement work. The pond was not an "added feature" as ******* noted in a text message about contractual agreements.
    Although he stated in a text on May 28, 2024, that he would send an estimate for the pond, I never received one. However, I took it upon myself to document the terms of the contract in text messages.
    Text messages are legally binding contracts when there is a formal acceptance or consideration for the project. His company clearly accepted the terms of the contracts.
    A company came in May of 2025 to assess the condition of the pond. They informed me of the following:
    1. I should receive a full refund because there is nothing correct about its construction.
    2. Clay was not stamped or pounded (as per the terms of the contract).
    3. The pond is not level and off by at least 6'.
    4. The dam needed to be at least 10-15' of pounded clay versus 2.'
    5. Clay should have been compressed in sandy areas.
    6. A clay trench should have been dug around the pond.
    7. Overflow pipe should have been 12" vs. 4-5."
    The company did not fulfill the terms of either contract.
    In April 2025, Russell's company documented he would fix the driveway, but needed warmer and dryer weather.
    I received a text informing me they will not fulfill the contractual terms. I also learned from *******, a list of top-rated pros, that this company filled out an application to be considered and were denied.
