Bought a 09 Nissan murano from this dealership. They told me only thing wrong with vehicle is needed the exhaust fixed. I pointed out that 3 tires were worn out and a tensioner pulley was making a noise. A couple days later the driver aide rear tire went crooked, had it looked at and found frame busted due to extensive rust. I contacted the dealership and was sent a message back stating they will do nothing as it was as as is car. I told them I worked at another dealership and didn't believe you could sell a car that was unsafe with frame damage and I can't put my daughter and grandkids in that vehicle.

    To Whom it may concern.

Customer and her father came on 02/22/2024 to look at 2009 Nissan Murano with 116K miles that we had advertised for $3950 online. Advertising ad clearly stated that car will be sold AS IS without any type of warranty. Customer stated that her father is Certified auto mechanic who works as a mechanic in car dealership closer to ours and wants to inspect the car prior purchasing it. We agreed and customer and her father took the car for inspection. After inspection customer who is mechanic came back with list of issues that he found after test driving and inspecting a car. He asked for discount in price because of the issues he found, we discounted the price for him and agreed to  bring the price down to $3188.79 which after taxes and fees ended up being $3697.01. Customer agreed to take a position of the vehicle in AS IS condition, and they took a delivery of the car after signing AS IS forms. After almost a month of owning a car, customer called us and told us that frame on the vehicle is damaged and asked us to fix the issue or return the money for the vehicle even though he inspected the car prior purchasing it and couldn't find any frame damage.  We purchase our vehicles from ACV online auto auction. ACV auto auction gives detail description on frame damage if there is any, however this car was purchased under green light condition, which means car is out of any major defects or problems, and frame is NOT rusted or damaged. We have an original online listing available from auction where you can see that there are no announcements about cars frame being damaged as stated by customer. We are not sure in what conditions car has been while the car was in customers position. Any damage could have been done in those days that customer had a vehicle in her position. We can't be responsible for any damages done after sale is over.  Vehicle has been inspected prior purchasing and conditions of sale were agreed, therefore at this time we won't be able to perform any good will repairs to the car.

[If you do not say why you are rejecting the company's response, BBB must close your complaint.]

    Complaint: 21417883

I am rejecting this response because:
They lied. **** told me the only thing wrong with the vehicle was the exhaust needed fixed. He said they inspected the car and found no major concerns. I only had a chance to drive it down the road and back as they were closing soon. We didn't have the vehicle for a month and even so frame rot due to rust dosent happen in that short period of time. I can see having some issues in an as/is situation but a broken frame due to rust shouldn't be a good will repair as it is a safety issue and they have put my daughter and grandkids in a potentially life threatening situation which apparently they are ok with as there were no repairs or offer to buy back the vehicle.

    Regards,
