    September 21st 2023 was the original purchase date.
    Item purchased- 2006 5.9 cummins engine that was described in sale listing as modified.(see attached screen shots of original listing)
    Filed dispute through ******** bank on November 21st 2023. That claim showed closed as off January 2nd of 2024 via mobile banking app (see screenshot)
    No other contact from the business or ******** bank after the first of the 2024.
    As of the end may ******** bank sent a letter stating there was no error and they are reversing the refund based off documents the seller had sent in after the claim was closed. (I was never notified about these documents or asked to provide further documentation to prove my claim.)
    I still have the engine from the seller and would like for it to be returned and a full refund to be issued.
    Attached are the the screenshots and photos of the engine and its internal components. Partial disassembly of engine was required to verify part numbers on the the following parts, Hamilton camshaft, 300% over injectors, arp chrome 625 head studs, head work and injection pumps.

    The part numbers were then researched. The cam and injectors came back to be just stock parts from an 06 engine. Not as described in sellers description. The head has no signs of any work done, such as porting, valve springs, valve retainers, pushrods or upgraded rocker arm. The head studs are not arp and do not have any of arp company’s markings or stampings. Arp fasteners are always stamped on the end. All and all the engine is complete but none of the aftermarket parts that were supposed to be installed and present in the engine are there. To source and purchase these parts separately would cost a significant amount more on top of the amount I have paid for this engine that was supposed to have these parts already.Seller deleted old listing, messages and blocked me.

    Mr. ****** purchased a used engine from an individual not from our Company ***. As the listing shows this was an individual not a business. Mr. ****** was told everything upfront when he purchased the engine. The engine was bought by the individual with the items described being stated when they purchased. Mr ****** was informed while he was picking up that there was no guarantee what was in the engine as they did not disassemble the engine they could only state what they were told. He was told several times that there was no guarantee what was in the engine and that there was no warranty with the purchase it was being sold as is. then several months later we had a reversal on the account where Mr. ****** tried to turn the transaction into a "Fraud" after submitting all the documents that we had to the bank it showed that he was not allowed to do this. We notified our local law enforcement in regards to this incident and made them aware that he was trying to get his money back without returning the item. There are no returns on used items. 3 months had went by when Mr. ****** tried to be sneaky and reverse his transaction. Also Mr. ****** had stated in his first dispute that he had purchased on 11/21/2023 which was 2 months after he really purchased the product. There was others at the shop that day that over heard all the conversation and that everything was told to him at the best of their knowledge again that the engine was purchased to install in a personal truck and that they were told that the items were in the engine and that we could not verify as they hadn't had it apart and decided they didn't want to build the truck now. Mr. ****** never brought the engine back to the shop for a refund as he stated and also was aware that there was no refund again sold as is no documents no warranty etc. This is how the engine was purchased by said individual and they can only tell you what they were told.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. 

    The item was listed by the individual which is the son(Tyler) and main mechanic at *** automotive. The transaction was made through the business of *** automotive. I was told by Tyler of *** automotive that the engine was being sold to me as described in the ad listing although he did not have receipts for the parts installed inside the engine. Tyler did tell me that he purchased this engine from a trusted source for one of his projects and knew the parts that were in it. Tyler cline, Ashley C****, and another worker were present when this conversation was had. Tyler also stated that if this engine did not run he would take it back and return the money I paid for it. When I called tyler at *** automotive to inform him of what I found and the lack of parts that were described in the listing he said he would call me back. Which in turn his father (Dustin) called me, I told him about the situation. He refused to accept the item back and refund the funds. Dustin also admitted to removing the upgraded push rods from the engine I purchased and installed them into a different engine. (This information was not disclosed before the sale or mentioned in the listing description.) Dustin told me that it is what it is they were apparently lied to by whoever they purchased it from and that is was ok that it was passed onto me. I filed a dispute for the charge with my bank, I sent out the injectors and both pumps from the engine to a third party to be tested. Both injection pumps tested bad and unable to operate an engine. The injectors test results deemed them as stock, not 300% overs as described in the listing. They also tested poorly and two out of the 6 Injectors are bad. Again engine could not run.
