    During our initial consultation, it was explicitly communicated that a geotechnical engineer's consultation was imperative due to visible structural issues with the old deck and concrete. The contractor acknowledged this and quoted $1,500 for the geotechnical report. Despite our agreement and explicit instructions, the contractor failed to procure the necessary geotechnical evaluation.

    Timeline and Problems:

    Initial Delays: Several delays were encountered before work commenced.
    Foundation Issues: Upon inspection in July 2023, it was revealed that the geotechnical report was never obtained, a critical omission for project approval.

    Payment and Progress: Despite the contractor digging foundation holes, the work did not meet contractual requirements. Nevertheless, we paid $25,000 as per the contract. Since this payment, no further work has been conducted, and the contractor has been unresponsive to multiple inquiries and follow-up attempts.

    Current Status: As of May 31, 2024, the project remains incomplete with only a quarter of the deck built. There have been numerous instances of no-shows without any prior notice.

    Impact:
    The contractor's failure to adhere to the agreed terms and complete the project has caused significant inconvenience and financial loss. Additionally, the lack of communication and professionalism has exacerbated the situation, leaving us with an unsafe and incomplete deck structure.

    I am seeking the BBB's assistance in resolving this matter. I request an investigation into Vineyard Construction's business practices and seek a full refund for the payments made due to their non-compliance and failure to fulfill the contractual obligations.

    Enclosed with this letter are copies of the contract, payment receipts, and correspondence with the contractor, along with photographic evidence of the incomplete work.

    Thank you for reaching out with your concerns. We understand your frustration regarding the delays in the completion of your deck project and appreciate the opportunity to address your concerns.
    The project began with the approval and permitting of an engineered deck. However, upon the frame inspection, the building inspector determined that the deck should not have been approved in its original form, as it was on a hillside. As a result, we were no longer able to proceed with the work as initially planned and needed to secure a qualified Geotechnical engineer to redesign the deck, along with a separate company to dig down to bedrock as required by the new engineering specifications.
    Finding a qualified Geotech engineer and excavation company to meet these specialized requirements took longer than anticipated, which unfortunately led to delays in the project. We fully understand how this has impacted your timeline, and we sincerely apologize for the inconvenience caused. Throughout this process, we have continued to work with you and have remained committed to completing the job to the highest standards.
