I went to get a real estate sales document notarized. The notary at UPS Store #0226 charged $45 for a service that is mandated by Ohio State Statute not to exceed $5, this pursuant to Ohio revised Code 147.08 (A) (1) and 147.08 (C). The business refused to refund the overcharge and never advised me of the $45 fee prior to notarizing the document.

I approached the manager about this overcharge and they refused to refund the fee, I am also going to be filing a formal complaint with the Ohio Secretary of State - Notary Commission.

    Hello,

We charge $5 per act for any notarial act, that is set by the State of Ohio. A link below will bring you to the State's page and allow you to read the rules and regulations for being a Notary in the State of Ohio. We were fully in our right and legal to charge $5 per notary and there were 9 total notarial acts required.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

The business is charging excessive fees.  The Ohio Revised Code, section 147.08(A)(!) and 147.08(C) clearly states the following: "The fees charged under division (A) of this section shall not be calculated on a per signature basis."  This is clearly stated and in layman's terms.  I also intend to pursue the matter with the Ohio Secretary of State's Notary Division to pursue suspension or revocation of the Notary's license if this matter is not resolved amicably in this forum.

    Regards,
