TM construction is currently building an addition to my home. We had an original contract price of just under $700,000. We agreed to take on finishing items, specifically baseboards, window and door trim, and painting the interior to keep costs down. The project broke ground in July and we were told we would probably take occupancy in January. The drywall has been installed but now the owner is adding charges for items that should have been included in the original quote. While looking at the contract on his online ****** sheet, I noticed that the contract states that priming the walls and staining and sealing the doors was listed at the top of the “Paint” subsection. As we had not discussed priming the walls, only painting, I reached out to the owner to clarify. I was told it was a typo and he deleted it from the contract. I believe that it should be negotiated as it is listed in the contract. I also clearly wrote out why I believe we should not be charged for the additional items and he is refusing to finish the project until he receives payment. There were also two instances of "typos" where we were overcharged approximately $1,900 for other items. We have already paid around $600,000 towards the project and would like to have it completed properly. Interior fixtures have not been installed and the brick has not been laid, exterior fascia, gutters, etc. are not up, and the driveway has not been installed. Any help would be greatly appreciated.
