    Don ********************** Auctioneer .... ****** Estate auction I had the high bid on a 2007 ****** Tacoma the ad indicated it ran fine but had sun damage (paint issue). I looked at the truck prior to bidding but was told I could not test drive it. At no point did anyone indicate the brakes were an issue. The auction information also indicated it would take a couple of weeks to get the title due it having to go through probate court. At this time it has been over a month and I have not received the title. This truck was misrepresented in the auction information as runs fine also the title has not been delivered. The seller and the auctioneer put my life in danger by not disclosing the brake issues. If needed I can have a local auto shop provide a report stating the issue was present before the auction was held.

    I conducted an online auction that closed on Monday evening September 25th for the estate of the late **************************  ******************** had personally viewed the truck in question the day before on Sunday September 24th.  I had not personally driven the pickup, but had started it to make sure it ran.  The Administrator of the estate said the family had been driving it some since ****************** passing and that it was the main mode of transportation of **************** before his death.  I pointed out the paint was faded on the truck.  If I had known of any major imperfections, I would have noted it.  The terms of the auction are all items sell in AS IS condition and I noted that since this was an estate it would take at least 2 weeks to get the title since it has to go through probate.  The pick up of the items sold was the following day Tuesday September 26th.  ******************** came and picked up the *********** gave him the attorney's name and phone number if he needed to call about getting the title and told him it would take at least 2 weeks.  On Wednesday we gave the attorney all the information needed for him to get the titles of the vehicles sold transferred to the new owners.  At that stage I did my part and it was out of my hands as to getting the title transferred and sent to the buyer.  Weeks later ******************** was calling and complaining about the not receiving the title.  I asked him to call the attorney to find out the status of the process.  He said he called several times, and no one answered the phone.  I then called the attorney and they said it was at the court house waiting for the judge to approve it.  As far as a refund goes, I told ******************** that all proceeds from the auction have already been given to the attorney and he would have to call him.
