I paid them $2,297.63 on Nov 27, 2024 to build a 12’ x 24’ deck at our house located at **** CR A, Liberty Center, Ih 43532. Start date was Dec. 3, 2024. Mr. **** said the weather was too cold and his guys would freeze. The project was postponed. Finally he said April 3, 2025 it would be built. He cancelled again. In April 12, I phoned him and said if he didn’t start my deck that week I wanted all my money back. He said he would send me a check.
I received a check today for only $1581 with a note that job was cancelled at client’s request so he refunded 60% of deposit. I think I was more than reasonable waiting 5 months and there is nothing in our paperwork that says he’s entitled to keep 30% for doing nothing. If he didn’t purchase materials, they can be used in another job

Per contract agreement. If a client cancels a job order, they would be subject to a cancellation fee of up to 40% of the initial deposit.   She states we took 70%.  But as you see, we refunded 1581 of the 2297 on deposit. Which is 32%.  Lower then the i Entitled amount.  When a client cancels an agreement, with no wrong doing of us, they are subject to a termination fee. The only time the job was ever canceled, was due to inclement weather   Which the contract covers that clause

I am rejecting this response because:

There is nothing in our agreement about a cancellation fee. He refused to build the deck in a timely manner. I did not cancel!
He is not entitled to keep $1054 of my money for doing nothing.

    Sincerely,

Signed contract for this company to properly roof my house and garage. The 3rd day after completion, the roof was leaking water into the house. Contacted the business for 2 days and he would not agree to come out and look at the problem. He wouldnt answer the phone and the would respond with text. Pictures show the problems including a low spot where boards should have been replaced. Need a new roof and this business has told me to find someone else to fix it and will not disclose his insurance information.

The way we were spoke to and treated we will not be back and she won't be receiving a refund. She still has a balance with us.
