      I entered into a contract with a representative (Steve M*****) of Gold Tier Structures on 9/22/2023 for the install of a 20x20 barn with a lean to. We had some communication mishaps with the rent-to-own company but managed to rectify these issues by October 16, 2023. I was told a couple weeks maximum turnaround and hadn't heard anything up to 10/27/2023. When I called around to the various entities that these agreements are processed through I found that my order was never received by ******** ***** ******** (ASC). To date, we have paid direct to Gold Tier Structures (the ASC Dealer) $2067.00 which they refuse to refund stating that the fees collected are for their work they have done towards our deal with ASC which amounts to providing quotes on building that I designed on their website.

      Jared (Owner of Gold Tier) was asked if he knew the status of our order, he stated he would not have known our deal was in limbo had we not contacted him. I had called ASC/the Rent to Own Company/ and Jared multiple times throughout the day and every party I spoke to had no idea where my contract was. Jared finally pushed the contract over, again, to ASC and said he would expect them to call us within the day for scheduling.

      I have asked the dealer and ASC to refund the money and I have been denied each time by Gold Tier being told the deposit was the payment for their services in selling the structure. I was, however, offered a "deposit-free" structure if I was to do business with them again, which seems they could make amends to the current situation and do the same, but there in unwillingness to make any gesture that is amicable in this situation. I am instead being forced to execute on the contract and hope that my structure is actually delivered despite repeat failures to provide the product and service I originally contracted for.

      ******** ******** & **** ******** placed an order with Gold Tier Structures, LLC on September 22, 2023. Their signed order form was emailed to the order entry team at ******** ***** ******** at 8:38pm E.T. the same day. Gold Tier Structures, LLC and all of it's representative followed through with every required action to see a successful building project through. This complaint should be with ******** ***** ********, and not Gold Tier Structures. **** ******** told our owner over the phone that he accepted the efforts our team was taking to go above and beyond our set responsibilities as a dealer to rectify issues caused by ******** ***** ********. However, due to the complaint against Gold Tier Structures, and the requested refund on a non-refundable deposit for rectification, their building order has been placed on hold by ******** ***** ******** until this complaint has been removed/deleted and this matter is resolved through mediation.

      We have worked with ******** ***** ******** to get this scheduled, though this is not the outcome we wanted we want to move past this issue with Gold Tier and still have a pending complaint against ASC regarding the way this order was handled and their failure to process. I do not condone the actions taken by Gold Tier in holding the order hostage while refusing to work with us through a refund, as this seems the business is not looking out for their customer and only their reputation. Ultimately, if a refund was not going to be provided as stated by the owner he should not have tried to hold up the order while he waited for us to submit for removal of this complaint. That is poor business practice and not an acceptable way to treat a customer, nor very ethical.

      With the understanding the owner will respond and complain about us telling him we would have this removed last week, I would add that was our plan to do so. However, having the weekend/this week to sit and dwell on what he was doing as far as not issuing a refund while also holding the order in a standstill state it did not sit right with us. It seems we were not set to gain anything from the money we paid if we were not to accept his request to remove the complaint. Screenshots of these conversations and messages from the owner are attached. We accept the resolution that we have provided ourselves, which is to move past this and deal with ASC on their end.
