      I was approached by a guy from State Construction about a free inspection for storm damage. I let him look. He was friendly and made it sound like he was doing me a favor. He found damage and said he can call my insurance company for a claim. I said OK, but didn't realize I would be on a 3-way call with him and my insurance company that night. It all happened so fast. He met with the adjustor. Claim approved. He started asking for my check, and I hadn't even seen what the money was going toward. No estimates, no idea what the work entailed. I felt very rushed and pressured to get the job done, and I didn't even know what the job was. I started looking into the company because I had only ever talked to one person. He wasn't mentioned anywhere on the website. I couldn't verify he even worked for the company. I called the number on the business card. I got an answering machine. It was after hours, so I called the next day and left a message. After several days with no response, I voiced my concerns to this person. He gave me the cell phone number for the owner. The owner then called me that night and gave some excuses about not manning the office. We talked about the check, and he told me I could bypass my mortgage company signature on the check and sign the check over directly to them. He was pushing to come get the check from me the next day. I asked for estimates. It took several days for me to get anything, and when I did, it was a "scope of work" form. They weren't covering everything my insurance wrote for, but they were taking all the money. And I still did 't know what I would end up paying out of pocket for. I started talking with my neighbors who were also having the same reservations. They mentioned a contract stating I would have to give up 30% of my insurance money if cancelled my services. I was never given this contract nor was any of this explained. I cancelled my services in writing and asked for a written response back. No word after 2 weeks.

      Our team member met with you after a storm event and provided a complimentary inspection, which identified legitimate damage to your property. With your full consent, he assisted you in initiating an insurance claim, including participating in a three-way call with your carrier—a common and transparent step to help guide homeowners through what can be a complicated process.
      Once the claim was approved, our team met with your adjuster, reviewed the insurance scope of work, and began preparing to complete the repairs according to industry standards and your policy’s coverage. At no point was any work performed without your permission, nor did we proceed without written agreement.
      Contrary to what was stated in your review, you did sign a legally binding contract with State Construction LLC. That contract was provided to you at the start of the project process, and included a standard cancellation clause. You are not within the legally allowed timeframe for a right of rescission under Ohio law, and your unilateral decision to cancel services—after your insurance claim was approved and scoped—constitutes a breach of contract.
      We believe this cancellation was not due to a lack of communication or misunderstanding but instead a decision to retain the insurance proceeds without completing the work. We will be pursuing all available remedies to recover damages incurred as a result of this breach.
