      On July 23rd I purchased 10 ton load of filtered top soil from ***** Trucking that they delivered later that day. It was my intent to use the top soil to fill several above ground garden boxes but I have not been able to complete that project due to multiple medical issues that I and my family have experienced since July 23rd. We collectively have had 15 doctors appointments, 3 ER visits, 1 operation and I personally have suffered 2 major falls that left me bedridden for several weeks. Upon recovering I started to setup a compost bin that required some soil to raise the ground level so I ordered a load of silt on September 30th. Upon delivery of the silt soil I noticed that the soil delivered on July 23rd was not what I ordered. The weeks of rain had exposed the soil was not filtered top soil and is full of stone. I called ***** Trucking about the wrong delivery and asked them to send me filtered top soil that I paid for and also offered to keep the unfiltered soil at a discounted rate. The owner called me to say that she would not make this mistaken delivery right with an explanation that I waited to long to report the problem and alueded that the stone came from my driveway. I explained that the load of soil was on my lawn and that I was not aware of the wrong delivery because of my and my family's medical disabilities and extended delay due to the days and weeks of rain. But she would not agree to do anything to make this right. Can you contact ***** ******** and convince them to reconsider their decision and work an equitable solution that would benefit both of us, customer and service company. Attached are several pictures showing the amount of stone that all of the rain exposed in the soil.

      On May 27, 2022, ****** ****** had 10.35 ton of Screened
      Topsoil delivered to his location.  On July
      23, 2022, he had 10.10 ton of Screened Topsoil delivered to the same location.  Before delivering Screened Topsoil, our
      drivers make sure to clean out their beds of their dump trucks prior to loading
      the material.  This ensures there is no
      debris of any kind to contaminate the material.  We load the Screened Topsoil out of a covered storage hut, which keeps
      it dry.  On September 30, 2022, he had a
      delivery scheduled for Silt, in which we delivered 21.45 ton.  When placing this order, he said nothing
      about being dissatisfied with the two previous orders.  In fact, he ordered Silt, which is a grade
      lower than Screened Topsoil.  He told me
      he did not want the “premium material” that he ordered before.  If he was in fact dissatisfied or thought he
      got the wrong material, why didn’t he mention it beforehand, seeing how he
      walked out to show my driver where to dump each load? We strive on customer
      satisfaction.  If a customer is not
      satisfied or did not get the right material, we make it right within a reasonable
      time.  This is not a reasonable time. He
      should have called me the day of delivery, not four months later. We delivered
      the correct material.  You simply cannot leave
      screened topsoil exposed in extreme weather conditions, such as heavy
      rain.  Research proves topsoil must be
      covered with a tarp if not used because it contains living organisms and hence
      anything can grow in it right away.

      What a shame to blame the customer for a wrong delivery of product that is clearly the responsibility of the company. I am a personal with disabilities who suffered many issues during the time period that ***** claims was to long for them correct. Including a severe burn to the bottom of my foot that required 3 ER visits in that time frame. And to hear their excuse that the driveway stone had mixed into the top soil is false. The top soil is still laying in my yard, not driveway, from when it was delivered. And the stone in the top soil does not match the stone in the driveway. I  asked them to deliver what I paid for and offered to pay a discounted rate for what they actually delivered. Reasonable offer to make this right. Come see the top soil for yourself, its in the same place and has not been touched by anyone.
