    On 10/22/2022, my Wife and I had dinner at the Benchmark restaurant, 6130 Levis Commons Blvd, Perrysburg, OH 43551. I woke up early in the morning having to vomit. My Wife did not vomit, however she did feel nausea the next day.

    We had breakfast early that morning and had no issues. We even decided to skip lunch that day, because we heard the portions were large from friends of ours. So we know 100% the illness was from the Benchmark.

    The owner and his wife called me and said there was no possible way we could have gotten sick from their restaurant, because they served over 400 people that night, and no one else complained of any issues. I think they are waiting for a mass food poisoning outbreak before they will except responsibility. Their attitude on their training, their quality of food. I find very irresponsible to think working in the food industry, things like this cannot happen.

    We had dinner on 10/22/22, early morning 10/23/22 I got sick. I should have called the restaurant the next day, but I wanted to do my due diligence before calling. I believe it was on 10/28/22 I contacted the restaurant.

    Zero commitment to me: Because I said I would not be back, the owner would not refund our money.
    Nature of the dispute: Becoming sick after eating at this restaurant and asking for a refund for the terrible experience we had after.
    Resolved the problem: Owner said he would not refund our money because we did not get sick eating at his restaurant.

    After sharing our experience with our friends, and hearing how the owners have treated us. Regular visited customers have said they will now try new places.

    Dear *******,

    Thank you for bringing this matter to our attention. It is unfortunate to hear of you and your wife’s post
    experience, and for that we have diligently and thoroughly completed an in-depth investigation from
    the night of your attendance.


    After conducting a full examination including obtaining the meal items you purchased via your receipt,
    there were a total of 298 guest served that evening. Out of the 9 meal items you ordered, an additional
    113 (122 total) of those exact meal items were served to different guests amid that evening as well.
    Upon our company receiving notification of your complaint via email 7 days later, our company
    immediately responded back with our proper protocol of attempting to gain your contact information to
    discuss the stated problems, gain understanding and to discuss resolution options. This was completed
    via multiple email correspondences between yourself and our company. It is with great concern that
    our company handle these complaints swiftly, and methodically.


    Upon various phone conversations between yourself and the General Manager of Benchmark
    Restaurant- **** ********; and yourself and Benchmark Restaurant Group, LLC. Vice-President ****
    *********, verbal communication of our company protocols was reviewed including: discussing our
    sanitation guidelines and protocols to prevent foodborne illness, and our thorough staff education and
    ongoing training to identify and prevent foodborne illness in our restaurants.


    Additionally, with any BBB compliant pertaining to restaurants, the Wood County Health Department
    was notified and completed a separate investigation on November 14, 2022 pertaining to this matter.
    (As a standard procedure, our restaurant already complies with a monthly Health Department routine
    inspection to keep our operations open, and has done so for the past 5 years since the restaurant
    opened.) The findings from the Wood County Health Department, State of Ohio, Authority: Chapters
    3717 and 3715 Ohio Revised Code concluded that our restaurant was in compliance with foodborne
    illness risk factors and public health interventions. Moreover, our restaurant had no further reports of
    illness from that night’s meal service.


    In conclusion, it is our honest and sincere belief that our restaurant did and will continue to take every
    precaution to prevent foodborne illness.
