    Problem began in 2020 with notification, to my husband and myself, that we owed $6637 in taxes from prior tax year 2019. Taxes were prepared by local company, Tax 29. We met with President ************************* who looked at the 2019 return, found the mistake immediately and said that the newer associate who had prepared the return, reversed line items. We had received a large refund which we paid back to the **** Tax 29 filed an Abatement Request and **** stated " this is a routine request, will be no problem". He also stated in the explanation section of that request that WE made the error unintentionally, we are honest taxpayers and the error should be forgiven. I did not realize until recently that ******************** deliberately misrepresented the truth in that explanation.We heard from the *** again in2021, penalty was not handled, contacted Tax29 again and also wrote letter to *** explaining situation. Copied Tax 29, ******************** continued to say they will handle the problem. Similar story for both 2022 and 2023. Continuing letters to *** and copying Tax29. Called Tax29 repeatedly, finally heard back late summer 2023 from lesser associate that ******************** asked them to call me to let me know he was taking care of this. He did not. In October of 2023 I received letter that our "overdue tax account " was assigned to collection company. I have talked with the company, made repeated calls to TAX29 with eventual response about some form that was needed. I do not recall received a request about that and not sure why there was no followup and/or Tax29 would not just pay for the mistake they acknowledged from the start. I finally just paid the *** $1,319.47 today.********************, and Tax29, until this situation have been professional, efficient and honest; unfortunately that changed. Tax29 should have paid the *** for this mistake and they know that.

    Though we sympathize with the client's complaint. Tax 29 requested an abatement on behalf of the tax customer. Subsequently, the *** did not wave the penalty that was incured. It was never established that the tax preparer actually made the mistake. Each tax return is reviewed with our customers before submitting the returns to the *** in which the tax customers agreed with the tax filing at that time. At the time of completeing the return, the tax customer was in agreement with the tax preparation.

    I have reviewed the offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of my decision appear below.

    I reject the offer because there is no offer to accept.  ******************** references the requested abatement, which he did submit, and stated at the time that these requests "are commonly approved" and there should be no problem.  The *** did not approve the request, nor did they approve an additional request sent by Tax29.  What is unfortunate is that it seems that ******************** does not recall (upon presenting him with the original *** communication) that he looked at our 2019 return and immediately saw that a line item entry was misplaced.  He told us what was done incorrectly and identified which of his employees made the error - no longer with the company.  I should state that when the young employee was done with our return. he also called ******************** in to take a look at it.  I am certain that the "review" referenced is not a line item/page by page review - and if I could understand that level of detail I would not need to pay a tax preparer to do the work.  ******************** knows what took place, truly he does; and I would hope that he will consider doing what is right by reimbursing us all or at least 50% of the penalty we paid for the error he discovered was made by his Tax29 employee.
