      I am rejecting this response because:  April 30th's invitation was not a legally written notice it was a text message.  I should have been informed in writing on that day or before.  Not 8 days pasted the expiration date of the lease; which if going by your demands of a 30 day notice gave you another month of rent regardless of our wishes.  The apartment upgrades offered fixed absolutely no apartment issues in 117E.  Such as carpet, water damaged walls, mold and window screens. 

      My initial response to stay was before I found out you were going to be adding multiple fees that you did not state was also going to added to the increase rent.  Gas Fees, Trash fees, municiple fees, and pet fees should have been in writing and not kept from my knowledge.  That is purposeful deception.  

      I gave you a thirty day notice because you stated I had no choice, but in further reviewing my original written lease I found it to be a FIXED TERM Lease which means in the State of *************, no 30 day notice is required by law if the lease is expired.  You stated it expired on May 1st.  

      Auto-pay from the screenshots that I have provided as evidence shows that I turned it off.  I turned it OFF on May 21, 2025.  The screens I was offered on your site shows clearly that it was off.  

      I want a full refund and I want the current tenants informed of everything clearly.  There are to many senior citizens in those apartments, on fixed incomes that are not going to know what you are doing.  There needs to be full clarifications made.

      off the property before June 1st. They are giving absolutely no regard to the tenants in this area. My past rent was ****** per month and they took ******** from my account. They also claim that text messages are legal written documents. The apartment I was renting had wall to wall carpet loose enough to trip over, no screens on any windows, water damaged walls from water leaks, and none of this was going to be fixed to justify this kind of price hike on rent. And many apartments in the building were in the same condition or worse. They have bounced my account with my bank. They have not even considered pro-rating since I've left the property nor have they agreed to return my security deposit.

      ****** received a lease renewal invitation on April 30, 2025. A follow-up message regarding the lease renewal was sent to her on May 8, 2025, and she confirmed that she would be staying and renewing her lease. Apartment upgrades were offered as part of the lease renewal. Updates and renovations have been taking place throughout the property.

      However, on May 16, 2025, ****** submitted her 30-day notice to vacate. The lease renewal email stated that we require a 30-day notice for termination. Additionally, we do not prorate the last month's rent, and ****** was informed that she is responsible for paying the full amount of June's rent. ****** did not deactivate auto-pay until June 4, 2025.

      I would also like to include the information regarding the ******************************************************************* removing my money.  The lease that was signed with The Oaks, not RPG was a Fixed Term lease; there is NO 30 day notice needed in a fixed term lease that has expired.  My lease expires on May 1st and I left the property on May 27th.  I was not legally bound by any lease contract to give them. 30 day notice.  I feel they are deceiving the tenants at that property in order to gain more money from us. 
      And in regards to the auto pay the screens they are providing the tenants to view show differently to them.  The screen shots clearly show that the auto pay was not engaged for the e wirhdraw 1,133.58.

      As you can see in our previous attachments, the lease renewal invitation was originally sent as an email document on 4/30/25. We received no response from ****** for 8 days and proceeded to follow up by sending ****** a text message, also included in our attachments.

      Any maintenance issues properly reported will be addressed. We reviewed ******** account as well as work orders, there were none in our system reported by ******. 

      ****** was not going to be charge Pet fees. Municipal fees and Gas fees have always been the tenants responsibility. The only change in these fees is that instead of requiring the fees to be paid a full year in advance, these fees will now be divided into monthly payments.

      Section "24. Renewal" of the *********************** Lease Renewal that ****** signed states that, "The tenancy created hereunder may be renewed upon expiration of the initial or any subsequent term hereof upon such different or additional terms as Landlord in Landlord's sole discretion may deem appropriate. If Tenant wishes to renew the tenancy herein, Tenant shall notify Landlord in writing of such intention and cure any prior defaults no later than 30 days next prior to the end of the term hereof. Landlord reserves the right to deny any renewal request at Landlords discretion.

      A 30 day notice of the tenants intention to renew or vacate is required.

      Auto Pay is not the only method of payment available. Our account ********************** system timestamps the action taken. ****** set up auto pay on 1/31/25. It is the tenants responsibility to manage their payment method options. Please view the new attachment. Auto Pay was not properly deactivated by ****** until 6/4/25 as shown in our previous attachments.

      I am rejecting this response because:  Right now I feel like I am being pushed around.  Each complaint was actually given verbally during inspections since they were not an emergency.  I saw them being written down and I was always told that I was on a waiting list.  As for my lease I never received an email in my inbox or I would have responded.  I did respond to your text even  though a text is not a legal written document.  RPG has already admitted that I was not given any written notification till May 8th.  My lease Expired on May 1st.   As for Auto-Pay it was turned off on my end of your system.  The screen shots admitted into evidence shows you that.  And the auto-pay turned off on June 4th was done by RPG management in *****  I apparently was not granted access to turning it off properly.   The screens I was shown as admitted in evidence was all I was permitted to see and use on your site.

      The lease that was signed by myself with the Oaks apartments is in fact a Fixed Term Lease.  In the State of ************* a Fixed Term lease does not require a 30 day notice.  So, whether you required one or not makes no difference when I comes to the lease after Expiration...and the Lease had expired on May 1st.  If you had started the process with a written notice being delivered to my person before it expired then, yes a 30 day notice would have been needed.  In conclusion, first, a 30 day notice was not required due to the fact of an expired LEASE.  Second, I was completely moved out and off of your property on May 27th.  The keys were turned in to the on-site manager and he said he would take care of it.  I respectfully request a refund of $1,133.58.

The written documentation we provided clearly shows that ****** reviewed the lease renewal invitation and elected to renew her lease for another year. Later, she submitted a 30-day notice to vacate. Please refer to the previous attachments, as well as the new one included with this response. As a gesture to resolve the complaint, we are willing to refund $300.
      We hope this demonstrates our commitment to fairness and to resolving disputes in a professional manner.

      I accept the business's response to resolve this complaint.

      Though it is not fair at all.  The invitation letter only gave was your weak options at what your considered an upgrade.  I was never granted access to reviewing a true lease and what RPG Management was going to require.  I was told through a conference call with **** present about all the fees.  

      I will accept your offer of $300 and my security deposit of $795 should also be returned.   But I will not ever recommend or live in anything owned by RPG ever again.
