I received a 10 day vacate the premises because they claim that the rent I paid for September 2023 was $56 short. My rent went up when I recertified from $205 a month to $230 a month that was an increase of $25 dollars which is a $21 dollar increase from the past 2 years, usually rent goes up $4 a month, but that is not my complaint. So in August my rent was $205 and PK Management took $285 directly out of my bank account they admitted they charged to much and issued me a check for $80. They did the same in July 2023 but it was $25 more than I owed and they refused to give that back saying it was a bounced check fee but my bank told me there were no bounced checks. Now I paid my rent for September $230 which is what I owe and they gave me a letter stating I need to vacate the premises in 10 days because I owe them $56. They said the $230 I paid was $56 short of what I owe for rent. If anyone else is having these kind of problems please report them to the people that handle the HUD contract for your apartments I did and am waiting to hear back from themBusiness Response

The $25 fee was the result of a stop payment that the customer placed on the check. After speaking with Mr. *******, he stated that he stopped the check because the rent increase came out sooner than he was told. Mr. ******* is not currently under eviction. Anytime rent is late or not paid in full, a notice is issued. Our Regional Manager will contact Mr. ******* directly to discuss this situation.Initial Complaint

I am currently a tenant at Lakeside Garden Apartments in Durham, NC. The property is currently managed by PK Management, LLC out of Cleveland, OH. I have informed the property several times, beginning in early May 2023, that the AC unit in the apartment does not work. I was told by maintenance on May 17 that the unit needed a compressor and one would be ordered. I was later told, "the reason the AC unit cannot be repaired at this time is because the property is changing management and all repairs have been put on hold." It is now mid July, we are experiencing some of the hottest days of the year, and the AC unit is still not repaired. I spoke directly with someone at PK Management on June 19, 2023. I was told, "an outside contractor would be called to come repair the unit." It is now one month later and the unit is still not working. On June 20, under the direction of PK Management, the property did install a window AC unit in the apartment. This is not a studio apartment with just four walls, it is an 800+ sq ft apartment with a seperate bedroom. The window AC unit has to run constantly 24 hours a day in order to cool the entire space, which I refuse to do for fear of the extra electricity. According to my utility provider, my utility usage has almost doubled from the previous month and there are still 15 days left in the billing cycle. I believe, the same amount of time it took someone from PK to say "install a window unit", they could have called the outside contractor.Business Response

Our company is working diligently to complete the AC repair at Lakeside Apartments. This issue was outside of the scope for our maintenance personnel and a contractor had to be obtained. As of today July 26, 2023, we have obtained a bid and are executing a contract for the work to be completed. This process takes time, and we apologize for any inconvenience this has caused. As mentioned by Mr. *****, we have provided a portable AC unit to provide some comfort to the apartment until this is completed. The portable AC is only supplemental to his central AC. Since the portable has taken the place of his central AC for the time being, his electric bill is probably lower than it would be running a central AC unit. Mr. ***** is free to provide copies of bill comparisons from his electricity bill with the previous summer to the office for review. We will keep him updated with when he can expect his scheduled repair.Customer Answer

It has been over two months since I informed Lakeside Gardens of the broken AC. I just find it hard to believe it has taken this long to hire a contractor. And per the company’s response, the process of acquiring the contractor is still ongoing.

Hi this is ******* ******* tenant at Fairview Gardens Apartment in Anderson SC 29621. I've reached out to PK management multiple times about my pending eviction that's been spoken of since August of 2022. Here is my last message that I sent three times and discussed yesterday with the manager Mrs. Debra, and I've left voicemails for human/tenant relations...no response. "Hi this is ******* ******* tenant at Fairview Gardens Apartment in Anderson SC 29621. I've reached out to you guys several times as well as the Greenville office, and Mrs. Simone P. Tenant advocate. Some of the times I've contacted was about my pending eviction. I've been advised that my pending eviction is for not paying rent for July and August of 2022. The management team was aware of it, advised me of eviction...but they never filed. Months has passed and they advised about evicting me, but never filed. So months of unpaid rent is stacking up. So they advised that I should move to avoid being served an eviction notice because I am to be served the week of January 16, 2023 (this week). I advised that if they were already in the process of having the eviction notice served then they could go ahead and serve the notice. I'm honestly not fighting the eviction process. I just don't want another months rent added on. Because technically if they would've went ahead and evicted me it would've been a small amount that I'd owe even after moving. So if somebody could go ahead and serve me the eviction notice, I could get on through and move along. I'm honestly unfamiliar with the eviction process, I believe I'm to be served, appear in court so that there's no "damage" fees added on to the amount of money for rent fees, and then I'd pack up and move. Even if that's not exactly the process that is why I'd appear in court. I'm not fighting the process, I just need peace of mind by going to court to make sure no one would tack on other fees and then I'd move. And Fairview Gardens would regain the apartment."Business Response

I do not accept this response because, Mrs. W***** A.K.A Mrs. Debra has been stating about eviction since August 2022a hasn't filed yet, but delays eviction until she feels like it...which cost me more money the longer she takes. I've spoken with her since August 2022, she deflects by not giving direct answers. So speaking doesn't help at all. So no, going to someone for answers and they give you the run around/gas lights your concerns doesn't work for me.

We apologize that the desired eviction you are requesting is not moving as fast as you'd like. It will ensue in time. Nonpayment of rent does eventually result in an eviction. As long as you physically remain on the property, you will be charged rent. Please note that you are not required or being forced to remain at the property, you have the freedom and right to move out when you feel the need.

I do not accept this response, on the ground that apparently PK management is trying to make it seem as if I'm requesting an eviction. They (Mrs /Ms. Debra W***** has advised me since August of 2022 until now that I'm getting evicted. The fact that I haven't been evicted nor advised of the exact date of when they (Pk management) will file...so therefore I'm confused and asking what's going on doesn't mean I'm requesting to be evicted. Anybody who is continually advised of an eviction but has yet to be evicted would wonder what's going on. And I know PK management has advised that I could just move but I've advised several times that I'm waiting to be served, to make sure no false fees will be added to what has been stated that I owe. I've stated that verbally with Mrs./Ms. Debra, via email, over the phone with Mrs./Ms. Simone, and even on the BBB website.
