On 6/21/22 I hired Shawn R***** with his company, GEN Services Inc. to install new wire and electric service at my vacation property located at ***** ********* ***** *********** ** ******
We agreed on the proposal dated 6/21/22 for a total project cost of $11,460.42. I made the required $8300 deposit as a bank to bank transfer on 6/21/22.

No contract was signed outside of Mr. R***** emailing me invoices and us agreeing to work through emails, text messages and phone conversations. Nowhere in the emails or emailed estimate stated any company policies, return policies, restocking fees, etc.

Due to services not rendered and Mr. R***** being dishonest to me about work starting and completed when in actuality little to no work was completed, I terminated services with Mr. R***** and GEN Services Inc on 7/18/22.

I’ve asked Mr. R***** and GEN Services Inc directly multiple times for a refund, but I’ve received little correspondence from either party. The correspondence I have received from GEN Services Inc via emails states I will be charged undisclosed fees and will receive some form of a refund with no date disclosed. It is my concern I will receive little to no refund and no accompanying documentation itemizing these undisclosed and unnecessary fees.

I did receive a partial refund in a check dated 8/23/22 for $5,782.17. Therefore $894.46 is missing.

I’m requesting the remaining refund of $894.46. This is amount is calculated by the work completed ($1,623.37), partial refund of ($5,782.17), all subtracted from the initial $8300 deposit.

    ****** *****,

Gen received this complaint, during the assigned job construction safety the walls, building structure, roof, windows, and stair case was not completed this caused a issue at her home. She had consistently breach all sub contractors contracts (framers, drywallers, plumbers and electrical). Ms. Ebert has been harassing my employees, and made several post on social media. Since this issue we have taken the liberty to file a complaint in our court system our attorney will be in contact with Ms. *****.

    Customer Answer

    Date: 09/28/2022

I am rejecting this response because the details provided by GEN Services INC are not accurate and do not provide solution to this matter.

    1. The company's rebuttal states the condition of the property was not satisfactory. At no point was this communicated to me as cause for them to not be able to proceed in electrical installation. I actually have in writing stating when I would meet them at the property to move needed things, but this was out of me being courteous and not a stated requirement by this company. It was at this time when I came to the property to meet them as when I discovered no one was at the property and no work had been completed, however it was stated to me this work had already been completed. It was due to me being lied to and my project continually postponed that I terminated services with this company. No contract was signed stating any termination language and fees I would incur by terminating services. I was also told that the contractor who stated did work who actually did not complete work was fired by GEN Services. This was never confirmed to me and at this point I wanted to terminate services regardless.

    2. The company's rebuttal states I've breached other contractor's agreements - GEN Services has no knowing of any of my other agreements with other contractors for GEN Services has no relationship with those other contractors. No other agreements with other contractors were breached and the dealings with those contractors have no relevance to my work with GEN Services.

    3. The company's rebuttal states I harassed their employees. I called the office daily following up on when I'd be receiving my refund due to me terminating services with their company. Since they rarely replied to my emails and voicemails I continued to call to get resolution to my matter. 2-3 times when they did reply, it was with inaccurate or minimal details, therefore I continued to call to get resolution to my matter. No appropriate resolution has been given to date so I've had to take further action through contacting the ******** ********* ******, BBB, and leaving negative online reviews sharing my experience with this company who continues to dodge rectifying this matter.

4.This company has still failed to provide any documentation showing why and how $894.46 has been withheld from the refund I received. They originally told me that there was a 30% restocking fee to wire they had already ordered. Since I paid for this wire, I asked to just pick up the wire I purchased. They told me this wasn't possible and never sent me any invoices stating they actually did order wire, even though I requested this multiple times. Additionally, even if withholding 30% of wire was justified, that would only have amounted in a couple hundred dollars based off of the written proposal showing the amount of wire needed for the project. Therefore to date, there is no documentation supporting the withholding of $894.46.

    5. If this company has filed a complaint with an attorney, I've not received any notice of a court filing.

    6. I am requesting a complete refund of $894.46 to resolve this matter and do not consider this matter resolved until I receive this refund that is rightfully due back to me.

    Regards,
