    Breach of Contract This is what her lawyer called it. started the project 2 yrs ago & 5 contracts later, I hired Mayo to build a mother-in-law suite for me size of 997 sq ft on my daughter's property. Mr.Mayo said he could build in about 4 months.
    He failed to mention he does not have a crew & uses subcontractors or whoever he can get. !st contract was 11-2020, & $17,000 for a permit to start. 1st he took his family to Disney World. Then I found out Mr. Mayo was living in a camper while he was building his own barn home. I sold my house 8-2021 & on 9-1-2021 Mr. Mayo was at my door wanting 2 installments of $14,200. He also requested I pay him $11,000 cash for the utility room. Over $100,000 paid to him & I am left with an empty shell as of to date. he won't show receipts or what his cost is so I have no idea where my money is going. I have paid for many things ie: dirt, foam installation, lights, door locks to name a few that I believe Mr. Mayo should have paid over $ 20,000 . The deadline MUST be done by the end of Fall before Winter. My belongings have been in storage I am paying for approx 2yrs.

    Our company, Mayo Contracting Co., went into Contract with ********* ******** on October 20, 2020. This first Contract was to be completed in Phase I and Phase II. Phase I was completed and we are now in Phase II. 

    We have not breached our Contract with this homeowner, Ray Mayo has been working very closely with *********. There have been some unavoidable delays, weather, building department, pandemic, but, mostly this job has been moving in a positive direction.

    Phase I was completed and the customer ask Ray not to start Phase II until after her home (that she was living in) was sold. That took 9 months. 

    The county, where this project is located, took 9 weeks to approve a septic system. In the meantime, we were obtaining the building permit. 

    The Contract has a payment schedule that states how much is due after a certain amount of work has been completed. She was in agreement when the Contract was signed, but has since had a hard time understanding this. This has been discussed and explained several times. 

    A job project such as this, often has changes. Some changes made by the County, and some changes made by the customer. Our Contract states that any additions to the Contract will be discussed by the customer and the Contractor, Ray Mayo. 

    Before any changes are made, Ray will give his customer an Estimate of Cost for changes and all changes are to be paid in full ahead of the change. This customer agreed to this. The utility room addition was one of such changes. That was the $11,000.00 cost. The utility room is complete.

    This home is further along than she wants you to believe. This home is completely built, exterior is totally complete (siding and stone work), roof is totally complete, concrete is complete, rough electric, rough plumbing, rough HVAC are all complete. Upon framing inspection, the County needs a new Architectural drawing showing the moving of the interior bedroom door. That occurred due to the first drawing being incorrect. Which the county had approved. We are now waiting on the architect to complete this drawing. 

    The items she mentions in her complaint, that she insinuates that she has to pay in addition to the Contract are absolutely not additional charges. Again, this has been explained to her many times. 

    Dirt - Our Contract included rough grading (only) of the dirt from her footer. 
    She would like additional dirt. Ray has told her that if she has additional dirt delivered (at her expense) then he will have it graded at no charge to her.

    Lights - The Contract states that the homeowner is responsible for providing all light or fan fixtures (excepting can lights - we furnish can lights). We will hang her fixtures at no charge.

    Door locks - The Contract includes a front door lock and a back door lock. She chose a different lock for her front door – more expensive than the one included in the Contract. Ray told her he will rebate her the amount of the one in the Contract. He will install her own front door lock.

    Foam Insulation - The Contract states, specifically that we will install fiberglass insulation. This was explained to her in 2020. Recently, she said she now wants foam insulation. Foam is much more expensive that fiberglass. Ray has been in business since 1978 and has never sold foam insulation to a customer. Ray told her, she would be responsible for ordering and paying for the foam insulation and he would rebate her the total amount of the fiberglass insulation, that was included in the Contract. She agreed. 

    Cabinets – The customer wanted to order her cabinets ahead of schedule, Ray 
    told her she could and he would rebate her the entire amount of the cost of cabinets that was included in the Contract. She agreed. 

    Our company is trying to move as quickly as possible on this project. Our ultimate goal is to have a very satisfied customer. 

    Ray has discussed her project and monies quite a few times. I have mailed her hard copies of changes and payment schedule changes twice. I ask her to review, sign, and return to us in the self address, stamped envelope that I provided. We have not received any of those back.
