    Complaint: 22512685

I am rejecting this response because: The cultured marble was not ordered wrong. ***** was here on several occasions to custom order the pieces to the sizes we wanted. He said it was "No problem" to cut them down. He cut off the finished edge on 2 pieces and one piece was hung uneven. He also removed the rubber seal from the shower pan so the shower would have leaked. ***** told me multiple times that he has worked with cultured marble before, but that was a lie and part of me knew that (I should have gone with my gut instinct). If he knew, he would have known it was not ordered by the square foot, he would not have removed the rubber seal and he would not have cut off the finished edges.

See the pictures to get an idea of the negligent job ***** and his crew did on replacing the siding and the electric meter on the outside of the house (where the black mold came from). There are more pictures.

I did not make a mistake with the plumbing causing it to be moved. ***** needs to own that.

I did not agree to a delay of him completing any work that could be completed while waiting on the cultured marble that he broke. I thought he was talking about painting. There was plenty of work that could be done and he said he would do while waiting on the marble. The issue is that ***** started insisting on being paid before the job was done (which was not at all in the contract). He said he did not have any money to pay his crew. Who owns that?

***** had ignored me before, so Monday Nov 4th was not the first time. Then, I had a new contractor here and see all of *****'s negligent work and discovered that he lied about the timing of the shower door. I wish I could attach more photos. Other examples of negligence in addition to the siding was: no insulation in the shower caddy (it is an outside wall so water would have froze and shower would be cold). Shower pan seal was not only removed, but the pan was not mortared in place, the vanity was not secured, there was no U tube on the tub drain (sewer gas would be an issue), electrical fixtures not installed properly, after installing a new toilet, he left my house while the toilet was still running (who knows how long it was before I came home and discovered it running). And the new toilet seat was not on properly, I had to re-install it myself before sitting on the seat.

After all of this.... I realize what a blessing it was for ***** to break that cultured marble. My remodel would have been a disaster. I am relieved to fire him because he could not be trusted. Now need to pay someone else to correct *****'s negligence plus buy 4 pieces of cultured marble that were ruined and a shower door (that I paid ***** $3K for).

Another reason why I was glad to fire him because he told me that he planned to lay the carpet in my bedroom without removing the furniture. He said he does it all the time, lay half of the carpet, then move the furniture on it and lay the other half! This is what he told me he was going to do!! I knew that was not going to be the way I wanted the carpet laid, it would never be stretched properly!!!

My goal is that ***** does not treat people this way. He lied to me many times and promised multiple times the job would be done on time. If he knows how to do remodeling, he did not display it here. If he knows how to be a contractor and budget his time (His crew usually worked 18 hours a week) and money (saying he couldn't pay his crew or even buy primer paint), he did not display that at all.  I truly believe it was his plan to not be done on time, to start blaming me for what he called re-orders, and tell me that I needed to pay more money for them to come back and finish the job.

    Sincerely,

    ******* ******

his crew and he was not going to come back to my house until the cultured marble came in.
Today I discovered that he cut two of the cultured marble piece wrong, he cut off the finished edge. So now I need to replace 3 of the pieces of cultured marble. I also discovered that he lied to me about the shower door, the company he hired to do it does not come out as install it in one day and it is finished, they come out to make a template, then make the door, then it was going to take 3+ weeks for it to be installed. ***** was paid $3000 to get the door on order. The company said he never paid them anything. And they were told not to come until November 8th. ***** always promised me completing by November 1st. It seems to me that he never planned to have it all done on time. I will be talking to an attorney to see if I have a case worth pursuing, I'm not sure if ***** has any assets or insurance like he told me he had. I paid him $7500 upfront plus $5K for a second contract.

    Business Response

Hello. I am responding to a complaint received by ******* ******. Yes, I had a contract with her in which she terminated on November 4,2024. I was there working up until then. I was in communication with her through the whole process. The cultured marble was ordered wrong on her end causing it all to be cut to size. Between having to cut all the pieces to fit along with drywalling a new bathroom and closest causes a lot of dust and I explained to her. She understood and agreed to this process. The other contract she is speaking of was to remove mold found while gutting the old bathroom. We agreed and that contract was completed within a week but also took away time from the original contract of the bathroom's timeline. The piece of marble that was broke was on my crew and I was willing to replace it. I have completed a majority of the bathroom contract I had with her. I completely demoed the old bathroom removing the tub, shower, vanity, toilet, walls and floor. I installed the new plumbing twice because of a mistake on her end. The new shower, toilet, vanity, tub and fixtured have been installed. The new flooring was installed. The new closet and bathroom walls have been installed, drywalled and finished. I have pictures of before and after work that we have done and completed. I have text messages from her stating I would return to finish that last few things once the replacement marble was in which she agreed upon. I was asked after this agreement not to return to her home. This is when she terminated the contract. I am speaking with lawyers to see what my legal right are and if putting a lean on her house is my best option since she terminated our contract. Please reach out if there is any more information needed on our end as we have text, pictures and receipts to prove we held up our end of this contract and she is in fact who broke and terminated the contract.

Yes, she is correct on the facts that we went over her plans and measurements several times before the job was started due to her changing them and having some measurements wrong. The cultured marble was still ordered wrong. Which was not a problem its part of the process. I have not lied to ******* about anything. Yes, the toilet was running and as soon as she called the company, I was there within 15 minutes to correct the issue. I always answered her calls and stayed in contact, and I have all the messages to prove it in court. She is again the one who terminated the contract before we were able to complete it. I also have pictures, messages and receipts from this project proving work done and money spent. The contract was terminated by her not allowing the company to finish the job. Once the marble was ordered to the wrong size, I had no choice but to agree to cutting it and it not being a problem. I did not order that she did. I have emails and correspondence with the company I use for glass. The shower door was underway I canceled once she terminated the contract. The company worked with her every day went through several changes and problems that came up which where all agreed upon and fixed by the company and herself. Issues such as the black mold that was found where fixed and corrected. The plumbing for the bathtub fixtures etc. This was still an active construction zone, and the water was off when she terminated the contract. The company did not remove any seals from the shower pan, and the wall was in fact in insulated between the shower and outside wall. She also asked that the wall between the bathroom and bedroom be insulated as well for noise. The company could not finish or fix anything else due to the contract being broken on her end without proper notice which was stated in the contract.
