In July, 2024 we hired *** from Affordable Concrete Construction (ACC) to remove our old driveway, bring in 3" of new 411 limestone base gravel, tamp the gravel, install "Pink Bar" (Owens Corning high quality rebar), and pour a 4" concrete driveway using 4800 psi concrete. Driveway was to be a uniform slope (straight line) from the top of the garage floor to the top of the sidewalk. We were quoted $9100 for the 4 day job. We paid *** $4,950 on the 1st day. During the 1st day, we were presented with a new quote/contract with different specifications from the original quote/contract. We did not immediately notice the changes. That evening we noticed the changes. At the start of day 2 we conf***ted *** with the changes and told him they were unacceptable. *** tried to bully us into accepting the changes. When we refused to accept these changes *** began yelling and screaming at us. My neighbor heard the screaming and almost called the police.

The 1st day ACC removed the existing asphalt and tried to scrap away our old base gravel, but hardly removed any of it. This would not allow for a straight line slope from our garage floor to the top of the sidewalk. Instead, ACC decided to create a multi-sloped driveway, with a slope-break approximately half the way down. This is not what we asked for. ACC also reduced the specs on the amount of new gravel, the quality of the rebar, and the quality of the concrete. We believe these changes would affect the quality and strength of the new driveway. (Video evidence from my home security system available for review)

*** refused to install the new driveway to our specs. We told *** we would no longer need his services, asked for money back for work not performed, and asked him to leave. *** refused to refund any money.

We paid ACC $4,950. They worked 9am-2pm on day 1. They removed old asphalt, some dirt and gravel, and installed a few boards. Day 2 they removed boards & swept sidewalk.

    We are requesting $3000 refund.

I gave them an estimate in the beginning. We ripped out all asphalt went over slopes. I went over the contract and had the consumer sign. He wanted to make some changes and I explained what would need to be done. He had me put the dirt on the neighbors property. I let him know for me to clean up the dirt it would be an additional charge of $450. He put a stop payment on the check. He stated later that he wanted a guarantee of 5" of stone and I told him we can't guarantee. He stated we will not be paying you anymore. He wanted it 6" from his property. According to city ordinance and guidelines I would not be able to do that. He also wanted me to pour slab on an existing lay on his driveway.

I am rejecting this response because:

Affordable Plumbing and Construction is lying.

Lie#1 We did not request any changes on the original quote/contract for the design and construction of the driveway.  On day one, Ron had us sign a different quote/contract. In that new quote/contract we requested that he follow all city codes and ordinances. That is the only change we requested.  Ron made several changes to the new quote/contract that we did not notice until later that evening. When we confronted Ron with his changes, he tried to bully us into accepting them by yelling and screaming at us.

Lie #2  We never gave permission for Ron to dump concrete rubble from one of his previous jobs onto our neighbor’s field.

Lie #3  Ron never asked us for $450 to clean up dirt.

Lie #4  We never put a stop payment on any check.

Lie #5  We never asked for 5 inches of gravel.

Lie #6  City of Toledo Zoning does not prohibit a driveway from being 6 inches from the property line.

Lie #7  We never asked Ron to pour slab on an existing lay.  We do not even know what that means.

On March 9 *** ***** came to waterproof our basement because he told us previously that we had a cracked clay tile that lead to our sub pump and that water is unable to get to the sub pump due to it being broken. He told us it would take them 3 days to do and they would go around the parameter of the house and lead the pipes back to the sub pump. They completed the job is two days stating no water should get into the basement anymore because the perforated piping will lead it to the drain and gave us a warranty. A month and half later after a heavy rainfall water is coming back in through the same areas he supposedly waterproofed. When calling him back out May 2nd he admitted they did not do the back paremeter and said they would come back and do it on the following Saturday. Later that day on May 2nd he sent me a text with the guy that helped him do the work which I later found out he subcontracted named **** ***** stated he will not be returning because we need to fix exterior things to rule out those as a problem before he can offer any help. He stopped answering any of my phone calls and would only respond to text messages. Had another company come out for a second look about waterproofing the basement and found out the path Ron took to supposedly waterproof the basement was wrong and they dug up interior walls and not parameter walls like they claimed they were doing.

Quoted the 15,000 to waterproof the whole basement. In order to have the life time warranty and guarantee he would have to do the entire basement. He stated he only gets water in one room and didn't want the others done. So we charged him $5500 for just the room he wanted done. We let him know that we cant guarantee he wont get water in the other rooms. We told him not to finish the basement for the season just in case the water traveled somewhere else. Instead he did it anyway.  2 months later he said that another room flooded and wanted a refund. We let him know if he bought the materials we would do the entire the basement.
