Please refer to the copy of the letter that we sent to the service the evening of September 6, 2023. To date, we have not yet received a response from the business.
We had asked for the trees alongside our garage to be cut back from the property line adjacent to **** ****** ***. They were not. I have attached a picture of what the area in question looked like after the tree service left. The yellow line, generally, marks our property line. I have also included a picture of the area without the yellow line for more clarity of the area about which we are concerned.
Additionally, we had asked for a branch that was cut by the service to be removed. It was left elevated, in a canopy. Please see the photo with the yellow circle around the mentioned branch.
It concerned us that the employees did not check in with us, again, before they left. They left without saying a word. Earlier, we were made aware by one of the employees that they had another job to go to after our visit. We can't help but think that they were in a rush and may not have realized the amount of time that was needed to complete all that we hired them to do.
We would like the area between our garage and the property line, adjacent to **** ****** ***, to be cleared as was indicated in the initial mapping. This is what was agreed to and what was to be included in the cost.Business Response

Above is the work order for Mr. ********* job. We did not have another job to go to after, so I am very unsure of where the customer got that information. We will be happy to go and clear more off the property line if customer was not satisfied with the amount of branches that we trimmed. Our guys did trim back off the garage so nothing was resting on the garage except that little weed which can be pulled. When we go back to do trim more off the trees to the customers satisfaction we can pull that weed. We removed a walnut and trimmed a redbud tree also in the front yard. Everything on the job order was completed, just not as much was trimmed as the customer would have liked. The customer did not pay for any services yet so we will be happy to go back and do a little more trimming.Business Response

On July 6, 2023, All Seasons came out and took down oak tree in front yard. I was told by a person in the office and I was told by the worker who cut down the tree, that someone would be out within two days to take the stump out. I called the following week many times to get the stump removed and was told first that their stump machine was broken and they were getting it repaired. The next thing I was told was that because the stump machine was broken and they couldn’t get it fixed, They were subcontracting out their stump removal and someone would be in touch with me. Nobody ever called me. On Monday, July 17, 2023, I was told that someone would be out and I would receive a call back within a couple minutes. No call ever came. On July 18, 2023 I called again, and again was told , the office would call me back in a couple minutes that we are on the schedule. No call came nobody arrived to take out my stump. July 19, I called multiple times and was again told the same thing. That someone was coming out that they are on their way that I am on the schedule. Nobody called me, nobody came out. It was at this time that a girl in the office told me it would take two weeks or more to take the stump down. Something that was never said to me before. I have worked with them before And I never had this awful customer service. On July 20 I called the office left a message no response. I called the owner **** ***** and he hung up the phone on me. ALL we want is this job to be finished I don’t know why we’re getting dicked around but we are and frankly we are fed up with it .Business Response

We let everyone know that it takes 10 days - 2 weeks after the job is done to get the stump ground out, our stump grinder did unfortunately break which was out of our control, we are getting it repaired and will get it back in a couple weeks. However instead of having our customers wait longer, we did call another company to subcontract a few of our stumps. ***** did put her on the list and when Mrs. **** called into the office we did call the other company to verify that she was on his list to be done. He said he was trying to get through the list we gave him as quickly as possible, he is doing his own customers and ours. When I spoke to Mrs. **** yesterday, I did apologize multiple times and reminded her that it is normally 10 days - 2 weeks. Today actually marks two weeks mark that we did complete her job, as we were trying to get it done in that frame, it is an estimated time frame and never a guarantee. All Seasons Tree Care (319 Nebraska Ave, Toledo, OH 43567) engages in
- fraud (says they will do work and provide services that they don't provide),
- bullying (claims to record conversations which would prove the above to insinuate that the customer is lying)
- harassment (accepts responsibility for poor customer service and the proposed settlement of the transaction, then sends additional bills, says that the customer is lying, and threatens to place a lien on the property).

We responded to Mrs. ****** immediately and let her know we would come out the next morning to walk around with her and do more work until she was satisfied, which she agreed with and set a time of 8:30am and then when the crew and manager got there in the morning she sent them away. After she received the bill she then sent us an email saying that she would pay half the bill and then demanded that we send her a paid in full receipt. I called her and we emailed her trying to set up a meeting with the owner to discuss why she thought that she could just pay half the bill and she agreed to meet then changed her mind and contacted the BBB with a complaint.Customer Answer

I am rejecting this response because:Thank you for this opportunity to reply to the All Seasons response of February 28, 2023.
Regrettably, their response is dishonest in the details.
They did offer to send ****, who I understood was a manager, to meet with me after the service date and in response to my complaint. However, the fact is I have never met ****. I was always present when their workers were present. So this statement, “we would come out the next morning to walk around with her and do more work until she was satisfied, which she agreed with and set a time of 8:30am and then when the crew and manager got there in the morning she sent them away,” is untrue. If that had happened, I would have been happy.
I have never met ****. Also, please note that their communication (see the email chain they attached to their response) doesn’t say that the workers would be coming too. I did not expect work, just an opportunity to negotiate how to proceed in meeting the contract. I do not believe **** has ever been to my property. The two workers who had been such a disappoint came alone on that day without supervision. I did send them away. If All Seasons had done what they claim (sent a manager to work with me to get the desired work done), I would have likely been satisfied. When I asked the workers why they were here, they said to finish the work. I had no confidence in them. And this switch from what was offered (that a manager would come to discuss a resolution), resulted in deepening my concerns about the integrity of this company.
My only desire in this transaction was to have trees trimmed.

I attempted to resolve this matter in good faith, as the emails they provide document.
The final sentence in their message is unsurprisingly also untrue.
These are the details not included in the response: I spoke with a gentleman who claimed to be the owner of the company on two occasions. The first time was in November after I attempted to resolve the matter. He was kind and understanding, recognizing that his employees had failed to do the job they were hired to do. He understood that they left without doing the work. He understood that they left without cleaning up after themselves. He understood that they left without discussing leaving. He expressed remorse at that point. He understood, I believe, that I was going to have to pay others to do the work that his workers failed to do. He asked if he could come to the property with the workers to talk about how to avoid this sort of issue going forward. He spoke of his pride in his company and how difficult it is to hand over management to others. Perhaps he was referencing ****. I believed he was sincere. I welcomed that proposed visit but wasn’t contacted again until recently. The proposed meeting in November was just to improve their business operations and avoid customer service issues. There was no implied additional work to be done to resolve the original contract. I believed this person had accepted my payment as fair compensation, since only a portion of the work was done. I was never contacted to arrange this meeting after this conversation.
More than two months after I believed the matter was resolved, I was contacted by the company. At this point the person asked if they could arrange a meeting with someone from the company at my property. Believing that the matter was resolved, I asked what the purpose of the meeting would be. This is also documented in the attachments they sent to BBB. Eventually, a man called who identified himself as the owner. Instead of being remorseful as the previous person who claimed that title had been, this person accused me of trying to steal from the company. He said he was familiar with people “like me.” I asked if he remembered talking with me in November. I asked repeatedly what happened to the person who was so kind and expressed his pride in his company. Oddly, he offered to return the payment that I had already made. I accepted that offer wondering what he could possibly be thinking. The funds have not been returned. I did not expect them to be. I just mention it to document the unhinged conversation. This person called me a liar and said that all conversations with the company were recorded and through those recordings he could prove I was a liar. He claimed that he would put a mechanic’s lien on my property to get the funds. When it was clear that he was just going to bully me in an attempt to force me to pay more than the amount which had previously been accepted, I terminated the call.
As noted above, I acted in good faith to find a fair solution to the problem and acted in a timely manner to reach a resolution. I have made every effort to be a good consumer in this transaction.
I researched mechanic’s liens, based on his threat, read applicable Ohio law, and got advice from counsel about this matter. Based on that research, I determined to file a complaint with the Better Business Bureau. My goal is to be a good consumer of services and to hold this potentially corrupt and dishonest establishment to account in this case.
My complaint is not addressed in the response provided. They fail to address their dishonest business practices and bullying tactics, and further prove both traits through their response, ironically including the email chain that documents all my efforts at communication with them, but ignoring the call from November from a person identifying himself as the owner.
I believe their response is that they have done nothing wrong and that the fault lies with me. I disagree with that. They promised to do work and didn’t do it. I tried to resolve the matter in a fair and honest way. They resort to misrepresentation and distortion.
Ms. ********, how do we resolve this at this point if they make claims that are dishonest and spread out over months? I have sincerely tried to resolve the matter with them. I believed that the matter was resolved in November, but now they have called me a liar, sent a bill for the contracted amount (without showing the credit of funds received and marked past due), threatened my property, and submittied this dishonest account of events. What is left for the consumer to do in this case?

The highlighted responses saying I will see you at 8:30 and I sent the crew away were what Mrs. ****** sent to us. There is no dishonesty. Those are your emails back and forth to me. I offered to send the crew you agreed and set a time and then sent us away. You met **** the manager when he came out to give you the quote which his signature is on. He also showed up with the crew the day we tried to do more work for free to satisfy what you were unhappy with.Customer Answer

I am rejecting this response because:I have never met ****. He never met me at my property. If he claims that happened, he is misleading you. The only people who have ever been to my property were the two workers who did the unacceptable work.
I suspect if work were defined prior to the day of service and workers were supervised, the issues I experienced would not occur. Your responses place this responsibility on a person named ****. **** has never met with me.The only people I have encountered in person from your company are a gentleman who arrived in his car so that he could leave early to be with his wife at a doctors appointment and another worker, also a man with dark hair, slender build and maybe 5’ 8”. They didn’t do the work I defined as my priority, they did work on trees that were not in need of trimming and were outside the area I defined, they didn’t meet with me as I asked to discuss two trees I was concerned with, they expressed confusion about the scope of the job and asked if I had met with ****, they said that your office had been hit with chaos and that they didn’t recognize any of the office staff so we’re not surprised by the confusion, they spilled fuel in my drive, left litter everywhere, and despite my express desire to meet with them prior to leaving, they rolled out here at 2 without speaking with me.
When they arrived the agreed upon morning without the person I was expecting to meet, **** (please do recheck the email exchange—the only person scheduled to visit the property was ****), I asked them why they were there. They said they were there to trim by the propane tank. That was just a tiny portion of what they failed to do. I asked them why they left without talking with me. They said because the truck was full. It was unacceptable to send out the two people when had already demonstrated their incompetence.
Perhaps you believe that **** was here. He was not.
The person I spoke with in November seemed to know there was a personnel issue. Are you consulting with him?
I believe this matter was settled at that time and my payment accepted as fair compensation for the work done that day.
it Is absurd to assert that events occurred which did not.
