    House I purchased has a heat pump HVAC system that is completely filled with drywall, plaster, and insulation dust and particulates, no condensate drain line installed. The builder, AJ D******* claimed the home was "like new" which is inaccurate.

    Paint in basement foundation is fresh and after a couple weeks, showing signs of moisture intrusion. Builder knew and did not disclose on legal docs.

    This letter is to serve as a response to Mr. ******’s complaint regarding the purchase of his home at
    ***** ***** ** ** ********** ***** ****.
    I would like to begin by explaining to you the circumstances that I feel are important to address at this
    time. During the process of Mr. ****** purchasing the home he was given access to the home at any
    time and was able to visit the home on 3 separate occasions with no time restrictions. He walked freely
    throughout the home with his real estate agent and on one occasion he went into the home before the
    agent even arrived and was able to have free access to it. With that being said, he did hire a private
    home inspector and a written report was created by the home inspector in which he requested that I fix
    several things that he found problematic on his inspection. I fixed all of them to their satisfaction and
    the buying process was moved to completion. At no time did the home inspector site any issues with
    the HVAC system, no condensation line, or moisture in the basement or the issues of the countertops in
    the kitchen. At no time did Mr. ****** or his real estate agent contact me after the home sale for me
    to have an opportunity to address and fix these problems except for the countertops on which I gave
    him the company who did the work, his phone number. To my understanding, the owner of the
    countertop company did reach out to him, and they did discuss resolving it. Unfortunately, Mr. ******
    did not find his timeline agreeable, and communication stopped.

    I have told Mr. ****** that he was always free to contact me to discuss any problems or concerns he
    had at home. He did not give me an opportunity to come out and look at the issues so that we can
    resolve them. He only sent me a negative text message that he was reporting me to the BBB.
    I would also like to mention that Mr. ****** was given a top-of-the-line dehumidifier to run in his
    basement. The home is situated on a high-water table and the trees on the property do not allow for
    adequate natural sunlight so that is essential to have running. If he is not using the dehumidifier
    properly it will cause some moisture.
    I would like the opportunity to visit the property and assess the concerns and arrange to have these
    issues resolved to Mr. ******’s satisfaction. MAGAAS LLC is a reputable company, and we have every
    intention of handling all legitimate repairs for our customers. We appreciate the opportunity to be
    able to discuss the next steps.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.




    I received the multiple letters from the BBB and the rebuttal from Mr. D*******.  

    It takes more than 7 days to collect information and respond intelligently to a rebuttal and I've included some detail in the email.  

    I know you consider the matter closed, but I'm asking for you to review regardless and pass along to Mr. D*******.

    At minimum, I will be able to be truthful with a home buyer in the future knowing what I have to resolve and disclose.

    This letter is to serve as a final response to Mr. ******’s complaint regarding the purchase of his home
    at ***** ***** ** ** ********** ***** ****.
    I have tried different avenues to speak with Mr. ****** and he has refused to speak with me or allow his
    real estate agent to speak with me or my real agent in regard to his concerns. I even asked his real
    estate agent to provide me his phone number and the agent told me that he was not given permission
    to give his number to me. This does not show a good faith approach to fixing the issues at hand. To
    this day I have not been allowed to access the property to review the issues he has complaints about.
    If he would have contacted me directly first, this issue would have been resolved before contacting the
    Better Business Bureau.
    This is how I would like to move forward:
    1. Have Mr. ****** contact me directly or indirectly through his real estate agent or allow me
    to contact Mr. ****** directly.
    2. Arrange to visit the property and assess the concerns of Mr. ****** within the next 2 weeks.
    3. Work with Mr. ****** after the visit to make mutually agreed upon resolutions to resolve
    the issues and time frame of fixing the issues.

    What I am not willing to continue is this back-and-forth communication that is not
    accomplishing anything productive.
