On May 9, 2022 I had permanent eyeliner applied by ******* at Meraki Artistry in ******** ****. After the procedure we discussed aftercare and that there was no need for any touchups, as there is for permanent eyebrows (which I had Meraki Artistry do several months before this eyeliner procedure). I paid $450 on the day of service. 5 to 7 days later the permanent eyeliner had disappeared. On May 23rd, I called Meraki Artistry and left a voicemail to let ******* know that the procedure had not worked. On May 24, I received a text from ******* asking me to send her a picture of my eyelids, any medications and any skin care that I use daily. I sent all of the information she had ask for within a couple hours.
On June 2nd I had not heard back from ******* at Meraki Artistry so I text, asking if she had received my information. She replied that I would need an eight week touchup. After much discussion about what would be different with the next procedure, I agreed to a touchup and would not apply my daily moisturizer just in case that was the issue.
July 20, 2022 I arrived for my touchup on my eyeliner. We had a discussion about the touchup procedure and ******* assured me that the touchup should take care of the problem.
5-7 days after the touchup, my permanent eyeliner had disappeared once again. Since ******* at Meraki Artistry had told me that we needed to wait 8 weeks between procedures, I waited patiently to see if this time the eyeliner might become darker with time. Unfortunately, this did not happen.
August 18,2022 I contacted ******* once again through text messaging to tell her the eyeliner had disappeared once again. She ask for a picture, which I sent to her 5 days later as I was headed out of town at that time. After sending her the picture I waited to hear from her and never received a response. So, once again I reached out on October 28th to see what we could do. At this point, she wanted to do another touch up which I declined.Business Response

To whom it may concern,
On May 9, 2022, Ms. ****** received her first application of tattooed eyeliner. As she stated before, this was not her first time visiting the studio, and this was her second time reading over, initialing and signing that she understood what cosmetic tattooing entails. Before receiving any cosmetic tattoo, clients are informed what to expect, and how to care for their new tattoo properly. this was the second time Ms. ****** read and filled out a legal binding contract with Meraki artistry permanent cosmetics. in this contract it does state that the technician cannot guarantee any cosmetic results, and that everyone does heal differently. There is always a possibility of needing additional touchups. Any cosmetic tattooing, does require an eight week touchup. (How another humans skin heals is completely out of an artist’s control.) At the time of her service her eight week touchup was even complementary with her initial appointment. I will attach a photo copy of her signed contract and initialing each paragraph that she had been informed on what to expect and also the possibility that additional touchups may be required.
I have received many texts from Ms. ***** over the last eight months. Although her tone has been very demanding and hasty, I have remained extremely professional and patient with her. I have explained numerous times that her skin is extremely fragile and thin. In order to properly give her cosmetic tattooing on this part of skin, I have to work slowly and patiently to protect her safety, and not risk the chance of color migration under the skin. I have also offered to do an additional touch up for her, which was scheduled however she chose to cancel and deny her appointment. I will also be attaching photocopies of our entire conversation.
I do understand that Ms. ****** is frustrated, as I have stated to her before. Her safety and integrity of her skin must come first. I will not lower my standards as a practicing cosmetic artist, or put a client at risk in order to get a procedure done in one session.
Ms. ******’s procedure was completed on May 9, 2022 and a complementary touchup which was also completed on July 20, 2022. At this touch up I also informed her that there was healed Eyeliner however, her skin does seem to hang over top of the healed eyeliner. This is something that is completely out of my control. I also informed her if she would like to take it thicker, we would need to be patient and work slowly because of the anatomy of her eyelids. I have attempted to work with Ms. ****** to rectify the situation many times. A stated previously, she has denied any further touchups. She stated in her last text that she feels policies are put in place to be negotiable. Mine are nonnegotiable. Our policies have been put in place in fairness to all of our guest, contractors, employees, and vendors.

I am rejecting this response because:
I was willing to work with ******* throughout this process. I have been very patient and tried to work with her on coming up with a solution so that I could receive the permanent eyeliner I paid for on my first visit. I have not been nasty or disrespectful throughout this process and am offended that ******* would say that I have not been nice to her. I never received a copy of any documents that I signed in her studio and we never went over the fact that it was non refundable. I can honestly say that it never crossed my mind that I would need a refund. I would have been willing to continue trying to have permanent eyeliner but ******* could not tell me anything different that would cause the eyeliner to stay and not disappear within a week. I still feel like a refund is the appropriate outcome since I do not have any eyeliner on my eyes and will need to find someone else to find the correct procedure for me.

The consumer and Meraki Artistry Permanent Cosmetics LLC. entered into a legally binding contract on May 9, 2022 at 6:00pm. Attached you will find the legally binding contact signed by the consumer.
This contract clearly states that the consumer understood and was informed of the nature, risks, possible complications or consequences of micro pigmentation associated with this type of procedure, including but not limited to the following infections, scarring inconsistent color, spreading, Fanning or fading of pigments. It also states the actual color of the pigment may be modified slightly due to the tone of the color of the skin. The consumer fully understands this form of tattooing, and therefore not an exact science, but an art. The contract also states the technician can not guarantee any cosmetic results and that everyone does heal differently. There is always a possibility of needing additional touch ups. Each section was initialed and signed by the consumer.
Cosmetic tattoos require at least 2 appointments. The consumers first appointment was completed on may 9 2022 and her touch up was completed on July 20, 2022. All elements of the contract were fulfilled by Meraki Artistry Permanent Cosmetics LLC.
As stated before, an additional touch up was offered to the consumer and was agreed-upon. This is also in the texts that were sent in my previous response. The consumer has now declined that solution. At this time both appointments have been completed, and an additional touchup has been offered to the consumer.

In the contract it does not state anywhere that this is a non-refundable

procedure. I must admit that it never
crossed my mind that I would need a refund since I had my eyebrows done with no
problems. The day I went in to have my
eyeliner applied I ask Ms. ****** about my follow up appointment and she told
me that this procedure was different than applying the powder brow and no
follow up procedure would be necessary. After having my eyeliner applied and it disappeared about 5 days later, I
waited a few days to see if it would darken with time, which it did not. I contacted Ms. ****** and that is when she
told me I would need a touch up. I did
question her about the fact that it was suppose to be a one time procedure and
she said that the touch up would be included in the cost. I did go back for the second procedure and
had the same results. The eyeliner
disappeared in approximately 5 days. At
this point I became concerned about continuing to put “ink” on my eyelids that
had to be absorbing into my skin. I
showed concern and ask for a different ink or procedure to be sure this didn’t
keep happening. Ms. ****** convinced me
to come back for a third procedure and she would make the eyeliner thicker. On my first appointment she had told me that
it was not good to go thick on eyeliner as it would not look natural. I completely agreed that I did not want thick
eyeliner as I do not wear a lot of makeup. She had no other options for a different ink or any real solution to the
problem. After thinking about having the
procedure done again, I decided that I did not want to compromise my health for
thick eyeliner and ask for a refund. Since
I had never heard or read that this was a non-refundable procedure I assumed
Ms. ****** and I could work something out. As a consumer, it seems only fair that I could receive a refund for
something that didn’t work as promoted.
Ms. ****** keeps referring to the text messages that she
downloaded but I can’t find where she has downloaded our text
conversation. I also have the text
message conversation and feel that if she would download them onto this feed it
would show that I am being truthful in my statements. I am more than willing to share the entire
text conversation if someone can explain how to upload the texts.
