      Work was not done as per contract 3-15-2023
      Contract 3-15-2023 Catch Basin was to be dug up and lowered 1 to 2”. 4-28-2023 Worker told me he did not dig up the C Basin He pushed one side of the C Basin down put cold patch in Basin to hold it down. arrived 315 gone by 4. Invoice 5-1 2023 for $615.16 says they dup up the C Basin. 5-4-2023 ** **** inspected job Said the pushed down C Basin was lower than driveway Said Cold Patch needs to be removed. Said if they dug up the C Basin they would charge me. Cold Patch has damaged the Catch Basin and may have damaged the Drainage. Pushing C Basin down may have damaged the Drain Pipes. * **** was Loud, ANGRY and Red. Waving around a level. I am almost 90. He called me a Liar Twice. I was afraid. * **** says He will be happy to put a lein on the property.

      Drainage Work Dispute:

      On 3-13-23 we had a scheduled appointment to look at an existing catch basin in ****** ******** driveway, that was too high, upon looking at it in person with ****** ******** the basin was raised approx. 1” above the current asphalt driveway around it (so it was not draining the water properly).

      I talked with her in person about taking out the basin and lowering it approx. 1-2” lower, per the exact write up it did on 3-13-23.

      “We will dig up the 12”x12” plastic catch basin that is along the back edge of the driveway, bury it approx. 1-2” lower, so it is a little bit lower than the asphalt.

      We will patch back with cold patch asphalt around the basin, any asphalt that we have to remove to get the basin out (approx. 3-6” around the basin).

      TOTAL $683.51”

      I told her that day in person this was a small job and we would try to work it in before she had her driveway redone, which was supposed to happen around May 1st.

      We did work it into our schedule before her driveway was redone. A couple of days after we did the work, she called our office and I (****** ****) talked to her, she told me she was concerned about the Cold Patch asphalt, after a few minutes of conversation I realized she was talking about Cold Patch asphalt that was according to her put in the bottom of the basin, so I told her I would check with the guy that did the job to confirm if/why he put Cold Patch in the bottom of the basin.

      I talked to our guy the next day and he told me that she (****** ********) was concerned that the basin would raise back up with water getting under it, over time and he put the Cold Patch asphalt in the bottom of the basin for extra weight to keep it down.  He was trying to go the extra mile to alleviate her concerns.  I told our guy in this conversation that I realize and appreciate what he was trying to do, but he should have probably just left the Cold Patch asphalt out of the bottom of the basin.

      The Cold Patch asphalt in the bottom of the catch basin will not damage the Catch Basin, and will not damage the drainage system, which I did explain this to her while her and I were looking at it in person, I also did offer more than once to remove the Cold Patch asphalt from the bottom of the catch basin.

      I then called ****** ******** back that day or the following day (I do not know the exact day), and told her what I found out from our conversation.

      She in this (the second phone conversation) told me that the basin was not low enough and that our guy just stepped on it to lower it, I asked her in this phone conversation specifically if the basin was lower than the asphalt around it, she would not answer that question and just said it was not low enough.

      So, I stopped by in person to look at it on 5-9-23, I looked at the basin first, then went to the door and knocked on the door, and talked to her about it, she stated again that it had not been lowered enough and was not really any lower than before we did the work, and that water would not drain into it. So, I asked her if she would mind if I got a level out of my truck, and her and I could check it in person, she said that was fine.

      Upon checking it with a level and a tape measure I showed her it was approx. 1.5”-1.75” lower that all the asphalt around it (which was the original goal), this also means the catch basin was lowered by approx. 2-3” lower than its original height, because it was originally approx. 1” above the asphalt around it, and I discussed this with her.

      She still, with her and I looking at the level and tape measure said it was too high and that it would not drain water, I did around this point in the conversation say she was not telling the truth about that, and I said the level and tape measure do not lie.

      She wanted us to come back out and dig up the basin again take it out of the hole (because the quote said “We will dig up the 12”x12” plastic catch basin”) She stated that our guy did not take it out of the hole, I told her the goal was to get the basin 1-2” lower and we did do that (in fact we got it approx. 1” lower than the original 1-2” in the quote), I tried to explain to her that the quote meant we where going to do whatever the best approach to getting the basin at the proper height, that it does not mean we had to literally take the basin out of the hole just to put it back in the same place, to attain the proper height.

      I did state that if she wanted it dug up again, and redo the job to set the basin at the same height, just to say we took it out of the hole and put it back again, that we would charge her extra for doing it twice.

      I did offer to have our guy come back and take the Cold Patch asphalt out of the bottom of the basin and we would not charge her for that, she did not want to agree to that (removing the Cold Patch asphalt out of the bottom of the basin).

      She stated she had not paid us any money at that point, which was correct, she has not paid us, I told her that if she did not pay, we can put a lien on her house.

      I did not raise my voice at her, I was not slinging the level (it was on the ground to show her the height of the basin), and I did tell her more than once I had to go because I was late to my 12pm appointment, so if she was afraid, I do not know why she kept wanting to talk about it in her driveway, and as I said, I told her more than once I had to go.

      Received your letter on 6-6 2023 I am asking that you reopen Complaint so that I can respond to Deans Response. I am not satisfied with Deans Response. The driveway was to be seal coated NOT redone. The small job as Dean said cost me an additional $315.00 to have the cold patch removed & the drain cleaned. I will have added expenses to have the driveway fixed. Since they pushed the CBasin down they didn't have to remove the asphalt around the CBasin. I am getting an estimate to replace the asphalt. I was not concerned that the CBasin would rasie My concern was that the CBasin was not dug up as per contract. Dean said the would remove the cold patch. They have not called to set an apt to do so. I wanted the cold patch removed and I told him so. My Complaint was that the CBasin was not lowerd as per contract. He tried to convince me that the pushed down CBasin was lower than the Driveway and that all they were going to do. When Dean stopped by on 5-4 23? He had the level in his hand when he knocked on the door. Contract is a Contract dug up means dug up Not pushed down. Dean did not says you are not telling the truth. He called me a Liar twise. He said if I wanted the CBasin dug up he would charge me for diging it up twise. He never dug it up once. Again they made no effort to call or set an apt to remove the cold patch. On June 1 2033 Drain tech removed the cold patch and cleaned the drain. Have not received their invoice for $315.00. Dean did rasie his voice. He was slinging the level around the level didn't stay on the ground the entire time he was here. I was afraid of him. I am still afraid of Him. He showed up no call, No Apt I did not try to keep him I also had an apt. He didn't say I have to go He said I will be happy to put a lien on the property. I don't feel I should pay for work I didn't agree to and will be an added exspense for me I would like for you to review my complaint & Consider my concerns, You can call or text me at ******* ****
