      I am rejecting this response because:

      I took pics today of the soffits not being fully secured to the house - on both sides.

      The last pic is the sunlight shining through the gutter and whatever it's supposed to be attached to.

      I picked up two rusted and sharp utility blades, pieces of sharp vinyl, and nails all around my property.
      The installed siding still has holes, holes with exposed nails, and chipped wood throughout.
      The installed siding has many areas where the siding has been chipped.
      The installed siding has large blemishes which were caused by Van Martin drilling holes for necessary cables in the wrong positions.
      Boards of siding do not line up and are not caulked in areas.
      Unsecured trim around roof -- Van Martin has been back to fix this problem over 3 times and there are still there

      We are in communication with the customer regarding the mutual release offer. We have emailed and called. We are awaiting a response/call back from the customer.

      I cannot accept the mutual release from Van Martin Roofing as is due to the paragraph stating there will not be a 5 year workmanship warranty, as well as requiring me to withdrawal my complaint with the BBB.

      I cannot agree to the final amount due as indicated.

      I've informed  Van Martin on several different occasions - with photographs - of the soffits which were not installed correctly as well as informing them - again with pics - that the soffits were sagging.

      According to Mr. ******** since he did not see via the pics that there was anything wrong with the soffits although I indicated such as described above.

      In one email from Mr. ******** he indicates that Van Martin had no need to come be and see any of the issues I've discussed however today, via phone he stated that he's offered to come on several occassions,

      I've also included copies of emails and documents of my concerns listed above.

      I have decided NOT to participate in Binding Arbitration to resolve my complaint with ID ********,. I understand that because I have decided to not pursue arbitration that BBB must close my complaint. I have decide to pursue legally or via other avenues.
