    Horn Sanitation has placed a dumpster on our property without our consent for our neighbor's use. We have hired a lawyer who sent a letter to our neighbors stating that the dumpster placement is unlawful and needs to be removed. The neighbors have not asked **** to remove it. We went to Horn Sanitation with that letter and with our county assessor's documents showing that the dumpster is unlawfully placed and asking for it's removal. The receptionist said, "I will relay the information." No one has responded about removing the dumpster. Management with Horn Sanitation has not contacted us back despite several messages and phone calls. The receptionist continues to say the same thing each time we contact them, "I will relay the information." Yet no one is contacting us back after a month, and Horn Sanitation has not removed the dumpster from our property.

    We have been made aware of the situation concerning the placement of our dumpster on the easement for the sole usage of our customer, Mr. and ****************  Documentation has been provided to use from both parties, as well as reports, that are obtainable from Local and County Law Enforcement.  It is to our understanding that the ******** have been told on past occasions, by Law and County Officials, that this is an easement and allows placement of a dumpster for the Utter's to use.  Prior to the current contention between the ******** and the Utter's, the two families used to share a dumpster in the same location.

    We are also aware that both parties, the ******** and our customer the Utter's, have obtained lawyers and we, Horn Sanitation, await a final verdict.  We have taken the advisement of County Law Enforcement and will continue to provide service to our customer, the Utter's, while the legal system is working towards a resolution.  When this time arrives, we will be more than willing to support the decision and comply with the outcome, whatever that *** be.

    If the BBB would like updates on this ongoing situation, please let us know and we would be happy to provide them.

    I am rejecting this response because:

    Please see the attached letter for my response because this text box stated, "The added text exceeded the character limit 2000."

    o whom it may concern:
    ************ stated there is no need to contact us, I have to respectfully disagree. Horn Sanitation has 
    equipment on our legal property. The Utters do not have legal right to place a structure on the 
    aforementioned land. Please note that the area where the dumpster is placed is specifically a roadway 
    easement on our property. We had our attorney look over the original easement documents. What the 
    document states was also stated in the letter that our lawyer sent to the Utters. We also made this letter 
    available to Horn Sanitation and the BBB. The area mentioned in the easement is for the Utters to pass and 
    ****** along the roadway easement, not to place any structures.
    I regret to inform ************ that the Utters have given misinformation. The previous owner of our property, 
    ***************, rented a dumpster from Gills Sanitation. The dumpster was unlawfully left on our property after 
    *************** sold the property and transferred the rental contract into the Utters name. Gills Sanitation 
    respectfully removed that dumpster when we contacted them about the situation.
    Furthermore, local law enforcement has made mention that they do not have the authority to interpret legal 
    documents and advised to have a lawyer interpret them, which we did. Local law enforcement also stated 
    that they will not be involved in this situation as it is out of their jurisdiction. They would only become 
    involved to step in if someones safety is at risk.
    Although the Utters have been informed of their rights, they continue to step over the boundaries of them. 
    They attempted to have a local company dig on our property without our consent, stating they had rights to 
    authorize the digging. Unfortunately, they did not have the right to give authorization for that company to 
    dig on the easement and thankfully that company found a different way to resolve the situation.
    We have asked the Utters to have the dumpster moved to their property and they refuse. We have also 
    suggested the use of poly-carts, which they did not respond to. Unfortunately, Horn Sanitation has been 
    caught ** in what seems to be a vindictive power struggle by the Utters in regards to their rights of our 
    land.
    Please respect our rights and remove your dumpster from our property. Whether you remove it and place it 
    on the Utters property as to keep them as your customer or take it back to your place of business is at your 
    discretion. The current status of the dumpster is unlawfully placed on our property by Horn Sanitation and 
    we would like to respectfully ask for it to be removed.
