    Complaint Summary: Request for Refund Due to Faulty Tire and Warranty Refusal

    In January 2025, I purchased a tire from ***** Nissan in Elk City. At the time of purchase, the dealership refused to honor my eligible Nissan discounts, stating that I would need to pay full price and that it would cover the tire, installation, and tire warranty. I was assured both verbally and in writing that the tire came with a 65,000-mile warranty, and that any issues would be fully covered under this warranty.

    Within weeks, the tire began causing problems. I contacted the dealership for assistance, but was informed that they would not be honoring the warranty after all. To further investigate the issue, I had a certified third-party mechanic examine the tire. Their assessment confirmed that the tire was defective and required replacement well under the expected mileage. Moreover, they found that the faulty tire caused damage to my other tires—which were in excellent condition prior to this incident—and compromised the overall safety of my vehicle.

    I have made multiple attempts to contact ***** Nissan to resolve the issue directly, but my outreach has been ignored. I was in touch with the Service Manager, ****** ***** who was rude and dismissive and refused to assist. I am now requesting a full refund for the defective tire, as well as accountability for the dealership’s failure to honor the promised warranty. I believe this is a reasonable request given the circumstances and the safety risks involved.

    I respectfully ask the Better Business Bureau to assist in resolving this matter promptly.

    Windy Nissan made every attempt within our ability to assist this customer. Kumho would need a claim submitted and the tire returned for inspection to determine the cause of the default and warranty/replace the tire in question. Nissan Roadside Assistance phone number was provided for safety and cost of towing to the dealership for repairs. Our Service Manager was not rude but direct in stating what was needed in order to review the vehicle for safety, submit the necessary claim, minimize the customer's expense, investigate availability of a replacement and coordinate to schedule the repair. Our Service Manager apologized for any inconvenience and tried to address all concerns.

    I have attached photos of the so called “new tire” that Windy City Nissan and Dustin passed along to me. The reason they’re refusing to honor the warranty is because they gave me a used tire which obviously doesn’t come with a warranty.

    We do not sell used tires!! The tire was ordered specifically for the customer to match the other tires on the vehicle. All of the information was obtained when the customer called on 1/7/25 to schedule the appointment. The appointment was schedule on 1/9 to give time for the tire to arrive so the replacement could be done while the customer waited for it and drive it home. The tire order receipt and Repair Order are attached. We do everything in our ability to provide quality products and service.

    I normally don’t write reviews BUT I am completely disgusted with what happen when I purchased a vehicle ON 10-4-22 !!!!! I call to tell them I’d like to find something different, more roomy. This vehicle doesn’t fit my family , Or is there is ANY WAY possible to get my vehicle back that I traded in! I got the complete Run around, Told NO we can trade your car in ( THE car I purchased not EVEN 12 hours ago!!!) as I ask for my truck back they proceeded to tell me I can buy my truck back but there is no clause in Oklahomafor the Cooling off period• SO i call around to other local dealership an ask if this stuff happens an if they work with their costumers. EVERY DEALERSHIP I CALLED to said YES this stuff does happen from time to time , we want our customers happy an satisfied! So I proceed to call back to say I should be able to bring this vehicle back I am not happy with it. TY gives me NO it’s your Car now, we can trade it in?! What I HAVENT HAD THE CAR 13 hours at this point . I walk in owe 16.000 on my vehicle told them I wanted to stay in a certain price range an sucked me into a 40.000 dollar car, I’ve tried to ask to be out in something different completely run around I called other dealerships around town asking if this stuff happens from time to time they said yes so why are they pushing me to keep a car I’m not happy with. There’s something shady about the businesses I tried asking for the whole price about 4 time never told me I didn’t see a final number until paperwork was getting signed . They said my vehicle has problems so they didn’t pay me what they told me for it, also in the new vehicle I wasn’t sure at first this guy name Ty offered how he can make the seats leather , an tint window the works. After I sign “oh I can’t do leather anymore, since your truck has problems,(remind you my daily driver) never had issues, but told mei could pay for it out of pocket I’m completely unhappy with purchase an how they do business!!!

    Your letter was received in our office on Thursday 10/13/22.

    Mr. ***** ***************** came to our dealership looking for a vehicle.  After visiting with the Salesman, test driving the vehicle and agreeing to the Sales Price, they waited for our ****************** to obtain an approval for funding.  Once the approval was received, they both signed all necessary paperwork electronically before driving the vehicle home.

    The next morning, ***************** called the dealership asking to "return" the vehicle that was purchased. Our General Manager and most of the Sales staff were on the lot all day on Wednesday 10/5/22 dealing with customers and preparing for an event being held on site the same day. During this time, **************** called the dealership multiple times, cussing and threatening the staff answering the phones. The Sales Manager spoke with him, but he also cussed and threatening him. Police were called and informed of the complaints from **************** against the staff at the dealership. 

    On Thursday, after further review, it was decided to completely unwind the deal like it had never happened. Mr. ***** ***************** brought the Nissan back and drove off or our lot in their original "daily driver". So her "refund" was already issued on 10/6/22, the date of the complaint.  

    We always try to make our customers happy and everything seemed great when they signed the paperwork and drove the vehicle home.  We wish there could have been another outcome, but unfortunately, we were not able to do any more for this couple.
