I have recently been burdened with financial difficulties and need this deposit refunded. I was contacted on October 27, 2024 with a text that my cancellation will be processed. November 08, 2024 I didn't receive that refund and replied that I haven't received that refund. November 14, 2024, I called the office to speak to someone and I got no reply. November 14 I received a text "we're in the hospital can I call you later". My response was "Yes please, thank you". November 15, 2024 I texted "I didn't get a call yesterday, can you please call me today?". NO RESPONSE. November 18, 2024 the response was "we're still in the hospital, my wife had a double cardio bypass". My response was "Oh my goodness, I pray all goes well. I would like to get this resolved as soon as you are available". Again NO RESPONSE. November 25, 2024 I sent a text, "Good morning, I hope your wife is recovering from the bypass surgery. I'm getting concerned about the refund of the deposit and would like for you to expedite it as soon as possible. Please let me know when I might be able to expect it. Thank you". November 26, 2024, I again sent a text "Good morning. I'm hoping that you're not ignoring my texts because I really don't want to take this to the next level. I would like a response by the end of the day today. Thank you".This is the next step I'm taking to get this issue resolved. I am hoping that you will look into this matter ASAP. As I stated, I don't want to have to take a more severe action to receive my refund. I'm looking forward to a prompt response.Thank you, ****** ******* **************************************************************** ***************** **************

    After reviewing Mr. ********* order in more detail, He placed his order in February of this year.  See attached signed contract stating clearing all deposits are non-refundable.  He is not wanting to fulfill his responsibilities in the signed contract and though he has full liberty to cancel his order at any time, he will need to accept the cancellation and refund policy in the legal contract he signed over 8 months prior to canceling.

    On September 28, 2022, I received an email from 'Old Country Building Sales' stating the deposit placed on a canceled ****** Building contract would be refunded in full within 30 days.
    I have spoken by telephone to Mike and Roy *******. And sent emails.
    I have spoken by telephone, text and email to Matthew ***** and Mick *****.
    I am still waiting for a refund. $7856.75
    Below is a copy of the email stating a full refund will be issued.

I personally apologize for any confusion during our conversations regarding the site prep requirements to receive your building. In an effort to resolve the communication issues, we changed your key contact person. Matthew tells me that you would like to cancel your order. We will gladly accommodate your request. Though your contract states there is a 10% cancellation fee to be applied to all cancellations after 72 hours, we will not charge you this fee. We will process a full refund of $7856.75 within the next 30 days.
    Again, we are sorry to see you go, but wish you well in your building project.

    Ms. ******** Canceled her building a couple weeks after placing her order due to her refusal to complete her responsibility in prepping the site for her building.  The contract she signed clearly stated that she had 72 hrs to cancel for a full refund.  Because she did not meet that deadline there was a fee to be deducted from the refund.  After much conversation over multiple weeks, we agreed to refund the entire amount, but as a small company we would need to postpone the refund for a time to allow us the opportunity to come up with this refund.  Due to a slow couple of months she did not receive her refund and filed a claim in small claims court.  The judge agreed to my request and stated the payment arrangement that I was requesting would need to be worked out between Ms. ******** and myself.  Outside the courthouse we discussed this and I tried to offer a payment plan and Ms. ******** refused to allow me to talk at all and she immediately went and filed again with the courts.  I offered in a text to start payments but she did not respond directly with me only indirectly said no by filing in the courts again.  I am making an effort to reconcile, with not holding her accountable to the cancellation fee that she agreed to in the contract and offering payments but she refuses to discuss it at all.
