    To whom it may concern, I am filing this complaint on behalf of my GREENS AT PEBBLE CREEK APTS AS a resident I have attempted to put in my 30 day notice to move out on September 5th 2023 when I went in to pay my monthly rent . I was told then by the manager ***** that she would have to contact her manag to see if she could accept it since it has to be in by the first day of the month, The first fell on a Friday followed by holiday the 4th(labor day). She never got back with me that day to confirm whether or not it was approved for the notice to be accepted. I saw her near the mail box the following day and addressed her about the reply she told me NO she couldn't accept it it had to be in by the first I then asked for her manager number to call and see if any adjustments could be made since the holiday and friday was on the first she immediately told me no that she has to stick to the rules, or she would have to make exception for everyone. she was rude and had no understand to my situa. Prior to this I had spoken to **** about reloc she said. I had to pay a termination fee of 867 (fullmonthofrent) or I didn't have to pay if I continues w the property and they accepted housing. I then told her i did not want to stay at the property due to several other reasons that I was concerned with.... I put in an application at another property and the lady told me that I was denied due to me trying to break my lease and mentioned mustang schools are better then the village where I was trying to apply. When I started to ask questions about how so she became suspicious and just hung up the phone. It's very suspicious on my lease agreement I was here months when i was bribed to signing another lease so technically I was in two lease agreemen at once. I was told that they didnt honor month to month which my lease clearly states it renew automaticall month to month my rent also increased from 805 to 867. I feels if i was takin advantage of by being told i had to sign another lease.

    The Greens at Pebble Creek utilizes the ****************************** lease contract. The resident signed a new lease effective for 2.1.2023 thru 1.31.2024 on 10.25.2022. The new lease agreement states a rental rate of $867 per month effective for 2.1.2023, giving the resident more than 90 days' notice of any potential rental increase. The resident had the ability to move from the Greens at Pebble Creek with a 30-day notice and no penalty from 1.1.2023 until 1.31.2023. Once the new lease terms were in effect 2.1.2023, the resident was under a new contract agreement until 1.31.2024.

    As noted in the lease agreement at least 30 days' written notice of lease termination must be given. If written notice is given less than 30 days, this triggers the clause of one month's lease termination fee. If the notice is not in writing, it is not valid and not consider a notice of lease termination. The resident would be responsible for paying the lease termination fee due to not giving written notice on September 1st. The site office was open and staffed, there is also a rent drop box if the resident didn't want to enter into the office. A written notice to vacate could have been received and documented per the lease requirements and per policy on September 1st.

    I am rejecting this response because:
    I would like them to honor that I am under a fraudulent lease & that I was FORCED and had no choice into signing a SECOND lease with a higher rent rate , 7 months into my original lease date. I am wanting to be let out my lease w/on Penalty and also for the property management to stop defaming my character and falsifying things to make it harder for me to relocate. 
    I also would  like to be reimbursed any legal money that was *********** the new lease I was FORCED TO SIGN increase from 805 to 867 $62.00 for 8months.

    I'm sorry I believe that just my name has gone through as a response. In response to the rejection of our original response. All residents are notified 4 months in advance with the new rent amount and they have the option all the way up until 30 days before new lease is to start to give notice that they're not renewing or to come in and renew the lease. Nobody can physically be forced to sign a new lease. They must come in on their own free will. Renewing is only a requirement if you are planning on staying past your lease expiration date.

    I am rejecting this response because:

    There is no reason why I was REQUIRED to GO IN TO DO a recertification 4 months prior to my lease ending to sign a SECOND lease, when my lease states at the bottom paragraph #3 ( THIS ***** CONTRACT WILL AUTOMATICALLY RENEW MONTH TO MONTH UNLESS EITHER PARTY GIVE AT LEAST 30days written notice intent to move. 

    I HAD A LETTER PUT ON MY DOOR THAT STATED they had a DEAL LINE TO PUT IN! I WAS TOLD I HAD TO SIGN OR THEY WOULD GIVE ME A 30days notice to vacate! when my lease contract legally didnt end till another 4months! I TECHNICALLY DONT EVEN QUALIFY FOR THE APARTMENT (SECOND *****) I DONT MAKE the income requirements that TAX CREDIT REQUIRES TO EVEN STAY ON PROPERTY going into a SECOND ***** AGREEMENT so I DONT see how that would be a REQUIREMENT when someone income can change at any TIME DURING THE ***** TERM! Just doesnt make sense at all. 

    I am basically in TWO *****S AT THIS POINT I SIGNED FOR ONE FEBRUARY(2022) and the second one I was FORCED TO SIGN! OCTOBER(2022) 

    How does that even work when THE lease I SIGNED WAS FOR A ONE YEAR TERM!!!  

     

    THEY STATED THAT I CAME IN ON MY OWN FREE WILL TO COME SIGN A SECOND ***** WHICH IS FALSE INFORMATION. WHEN THEY PUT A NOTICE ON MY DOOR 

    They also state that that ITS A REQUIREMENT TO DO THE CERTIFICATION OR YOU WILL HAVE TO VACATE!! 

     

    I am wanting to be granted out my lease with out paying a termination fee (A FULL MONTHS OF RENT) when technically I never wanted to be in a second lease agreement!

     Also I am wanting for them to not DEFAME MY CHARACTER THROUGH RENTAL HISTORY (stating that I BROKE/or trying to BREAK A *****)WHEN I HAVE DID NOTHING BUT FOLLOW MY ***** AGREEMENT CORRECTLY. 

    This situation has been very stressful and lack of Truthfulness.

    The Greens at Pebble Creek is a LIHTC property which requires each resident to complete an annual recertification in addition to signing the lease. The resident was given the state required notices of recertification which include language stating that a 30-day notice of lease termination will be given if the resident doesn't complete the state required annual recertification by the mandated annual recertification date. The resident is given a 120-day notice, a 90-day notice, a 60-day notice and if the annual recertification is still not complete; a 30-day notice of lease termination for failure to recertify. The resident signed her recertification and a new lease effective for 2.1.2023 thru 1.31.2024 on 10.26.2022 of her own volition. The new lease did not go into effect until 2.1.2023, the resident could have given notice 1.1.2023 to move out prior to the new lease taking effect.
